Book Description
Has any good come out of the efforts to mediate the conflicts in the former Yugoslavia? The short answer is, 'Yes, but...' Mediation has brought about agreements that halted the fighting in Slovenia, Croatia and Bosnia. Yet, the negotiations took too long, and their achievements came too late. Between 1991 and 1995 some two hundred thousand people lost their lives, and close to two million were uprooted from their homes. Saadia Touval examines why the efforts to reach a negotiated solution have not been more effective. He calls attention to two lessons: that collective mediation faces much greater obstacles than mediation by individual states, and that a mediator's priority should be saving lives, rather than aiming at other objectives, or even pursuing justice.

Book Description
This title was first published in 2000: Yugoslavia’s dissolved at a time when rhetoric of the New World Order was firmly established in legal and political discourse. Nevertheless, the largely positive appraisal of international law’s response to the Iraq - Kuwait conflict has not been mirrored in relation to Yugoslavia. This book evaluates the peace-making efforts of the major institutional actors, whilst focusing specifically on the Badinter Arbitration Commission, an ad hoc EC-created organ required to provide legal advice on the issues surrounding Yugoslavia’s dissolution. Initially composed of constitutional lawyers, aiming to redraft Yugoslavia’s constitution, the Commission soon faced problems of public international law. Its’ jurisprudence challenges international lawyers to reassess their state-centric conceptions of international law in a world where most conflicts, war crimes and human-rights abuses exist within rather than between States. This book is vital reading for anyone interested in international law, international relations, politics and central/eastern European studies.

Book Description
The international community can creatively and aggressively address deadly conflict through mediation, arbitration, and the development of international institutions to promote reconciliation. The editors of this book designed a systematic framework with which contributors compare third party intervention in twelve conflicts of the post-Cold War period. They examine the role of international organizations--the United Nations, international development banks, and international law institutions--and they analyze the tools and forms of leverage in successful and unsuccessful mediations. Based on the case studies, the editors identify the most effective institutions, make recommendations for improving interventions, and elucidate several important insights into the mediation process and the role of the international community in dispute resolution.

Book Description
Conflicts in the international system, both among and within states, bring death, destruction, and human misery. Understanding how third parties use mediation to encourage settlements and establish a durable peace among belligerents is vital for managing these conflicts. Among many features, this book empirically examines the history of post-World War II mediation efforts to: Chart the historical changes in the types of conflicts that mediation addresses and the links between different mediation efforts across time. Explore the roles played by providers of mediation in the international system - namely, individuals, states, and organizations - in managing violent conflicts. Gauge the influence of self-interest and altruism as motivating forces that determine which conflicts are mediated and which are ignored. Evaluate what we know about the willingness of parties in conflict to accept mediation, when and why it is most effective, and discuss the future challenges facing mediators in the contemporary world. Drawing on a wide range of examples from the Oslo Accords and Good Friday Agreement to efforts to manage the civil wars in Burundi, Tajikistan, and Bosnia, this book is an indispensable guide to international mediation for students, practitioners, and general readers seeking to understand better how third parties can use mediation to deal with the globe’s trouble spots.

Book Description
The publication 'paths of mediation in Bosnia and Herzegovina' is among first attempts to speak up about mediation at one place and in a certain moment of time enlightening this phenomenon from many perspectives. It is a paper which professional community in Bosnia and Herzegovina (BIH) has been lacking as of the moment the Law was adopted. The major significance belongs to the attempt that consumers of the justice system are provided with as many methods of conflict resolution as possible, which was one of the concluding remarks of this paper. This paper, in addition to practical and legal analysis of mediation, emphasizes some of general problems in the judiciary of BiH, but also the future of mediation and strategies of its implementation. The publication is dedicated to the past, current, and future beneficiaries of mediation, tentative consumers, mediators, legal professional, and to the academic community. In other words, it may be stated that the publication was intended to all those who might seek mediation as a dispute resolution method, i.e. to a very broad circle of consumers.
