The International Emergency Economic Powers Act has become a powerful tool the executive branch uses to combat global terrorism and international criminal activity, and it serves as an instrument to extend American foreign policy objectives into the realm of global economics. The act allows for broad executive authority to impose severe financial penalties and restrictions on foreign entities threatening the security of the United States (U.S.), yet these powers are not always matched with criminal and civil penalties for those who violate sanctions imposed under the act. The act is generally imposed in two settings: the war on terror, and the war on international crime. It remains, however, a unilateral exercise by the U.S. in a world where other nations do not always recognize activities that can trigger sanction imposition under the act to be illegal or threatening to America's security. The act remains an outlier of international law, relying more on America's preeminence as the world's banking center as the primary "stick" for enforcement. The U.S. can prohibit American banks from assisting in foreign transactions of nations that refuse to accept sanctions, a significant threat in an age of global commerce. The act relies on U.S. financial influence more than it does on criminal penalties. In one of the most highly publicized instances of sanctions under the act, Lloyds TSB Bank agreed to pay $350 million in fines to the U.S. for a series of violations netting the bank billions of dollars profits. Critics suggest paying fines imposed by the act is a simple business cost, and the willingness of authorities to accept fines in lieu of criminal prosecution suggests the government is unwilling or unable to criminally prosecute under the existing act. The nature of the act and its use by the government is studied.
