The Supreme Court (SC) judgment on February 2, 2012 cancelled 122 licenses that were granted after January 2008. This created ripples in the telecom sector. The judgment raised concerns regarding the future developments in the sector as well as on the role and scope of regulatory authorities both in the sector and outside it. In view of the SC indictment regarding functioning of Telecom Regulatory Authority of India (TRAI), the issue was how would the TRAI and Department of Telecommunications (DoT) under which the TRAI functioned, maintain their credibility? Since the affected operators had made considerable investment from 2008 when the licenses were allocated until 2012 when they were cancelled, the companies were considering the options they had. Some of the companies such as Uninor and Sistema Shyam which were joint ventures (JV) with foreign companies wanted to explore the options they had under the Bilateral Investment Protection Agreement under which they claimed to be covered.

The Supreme Court (SC) of India in its verdict dated February 2, 2012 canceled 122 licenses granted on or after January 10, 2008 by the Minister of Communications and Information Technology (MoC&IT) Mr A Raja. This was in response to litigation filed during 2010 and 2011 by Centre for Public Interest Litigation (CPIL), Lok Satta, and Common Cause, all non-governmental organizations, and other eminent citizens.With respect to the cancelled licenses, the SC directed the Telecom Regulatory Authority of India (TRAI) to make recommendations for grant of license and allocation of spectrum by auction in 2G bands in 22 service areas and adopt the same approach as for the allocation of the 3G band.The petitions filed were related to the fairness of allocation of spectrum for 2G services in India, the role of the TRAI, the processes adopted by the Department of Telecommunications (DoT) for spectrum allocations, and grant of licenses to ineligible applicants.

This report provides a detailed review of the current spectrum management regime in India; provides a perspective on best practice as may be applied in India and in addition provides a consideration of measures which could be taken to enhance spectrum management activities in India. The radio spectrum in India is a national resource, owned and managed by the Government. The authority for day-to-day spectrum management activities is vested Wireless Planning and Coordination (WPC) in New Delhi. Formal interfaces have been established with key spectrum user organizations, whose spectrum management staff may be found in other parts of India, remote from the capital city. The spectrum management regime has to date been strongly biased towards fulfilling the needs of the State and serving radio communications requirements funded by public sources. However, during the last 5 to 8 years a demanding private sector has made significant investments in the roll-out of new services and systems. The private sector (and indeed several segments of the public sector) is not entirely satisfied with the level of service provided by the spectrum management organization. This report performs the following functions: 1) it provides a detailed review of the current spectrum management regime in India; 2) it provides a commentary on best practice as may be applied in India in connection with each of the above areas; and 3) it provides a consideration of measures which could be taken to enhance spectrum management activities in India.
