Book Description
Excerpt from Report of the Attorney General of the State of Colorado for the Years 1903 and 1904 The probable outcome of this suit has become much more favorable to Colorado as the conditions of irrigation have been developed. I do not consider it proper to go into a discussion of the case while it is pending, and such a procedure would prob ably not be tolerated by the Supreme Court of the United States. It is not, however, out of place to say that the State Engineer has been giving this suit close attention and has made a thor ough investigation of the waters of the Arkansas river, the underflow in the State of Kansas and the loss of the flood waters arising in Colorado. The results of this investigation show that only a very small percentage of the waters flowing into the river from the water-shed of the Arkansas pass beyond the State line. The cause of this is shown to be the formation of the river bed which allows the waters to sink. The investigation, which has been carried on under the most favorable circumstances during the past year, also discloses the fact that, irrespective of ditches, the large amount of flood waters which fall on this water shed are lost by sinking before they reach Dodge City. The history of the Arkansas river has also been thoroughly studied, and it is shown that the river is subject to great floods and also to remarkable scarcity of water. The literature cover ing the history of this stream for a number of years past shows that it was not a rare thing to find the bed of the river dry and that this condition often occurred previous to the commencement of irrigation. Book Description
Excerpt from Report of the Attorney General of the State of Colorado: For the Years 1905 and 1906 The opinions contained in this report do not include all that have been written during the biennial period. I have endeavored to select such as will be of more or less use hereafter, and have omitted those which have only a passing value. A great many requests for opinions have been made by per sons not entitled to receive them. These have been refused, ex cept in a few cases. There is no law requiring the Attorney General to furnish opinions to persons other than State officers, the Legislature and State institutions. Book Description
Excerpt from Biennial Report of the Attorney General of the State of Colorado: Years 1911 and 1912 I priweeded to file the abstract of record in the case and briefs on behalf of the Consumers' League. Upholding the valid ity of the act of 1007 with reference to the Railroad Commis sion and its powers. The railroad companies. In their briefs filed in the court, raised the question, not only of the validity of the Commission, but of its power to fix maximum rates; to which latter contention a brief was filed by this office. I then secured the advancement of this case on the docket of the Sn preme. Court. And in an exhaustive opinion. Handed down by a unanimous court. It was held: first. That the Railroad Act of 1907 was constitutional; and. Secondly. That the Railroad Com mission had the power under that act to fix maximum freight rates. And to see that all rates should be reasonable and just. Ind that there should be no amine preference or discrimination with reference to rules.
