Esta doctrina ha sido, ciertamente, dominante, hasta que el Estado ha empezado a ejercer funciones comerciales, sean éstas realizadas por él mismo o por medio de una entidad pública o Agencia estatal, entablando una relación comercial con particulares. La idea de que la controversias se susciten en este ámbito puedes ser sometidas al arbitraje comercial internacional, ha sido patrocinada fundamentalmente por los operadores mercantiles privados que han preferido someter la cestión a arbitraje antes que a la jurisdicción de los tribunales del Estado afectado, por entender que se tienen más garantías de neutralidad, respecto al juez del Estado. La cuestión del sometimiento del Estado y/o sus Agencias al arbitraje, ha tenido su punto álgido con la aparición de las llamadas naciones en desarrollo emergente, que siguiendo el modelo de los antiguos Estados socialistas, tomaron a su cargo la propiedad de los recursos energéticos, flotas mercantiles y aerolíneas y empresas bancarias y de inversión.
