Excerpt from The Law of Real Estate Agency: Having a General Application to Principals, Agents and Third Parties, as Deduced From the Decisions of the Courts This work is designed principally for the use of Real Estate Agents, and its preparation was suggested by the want of any work especially devoted to the law of agency as applied to real estate transactions. Among the numerous publications intended to serve as guides, or manuals, for popular use, there are some which incidentally touch upon many of the subjects herein discussed, but in such a manner as rather to mislead than aid the reader. This is not because of the incorrectness of the doctrines laid down, if considered as absolute propositions of law, and where properly applied; but for the reason "that for the want of a due discrimination in this respect, very erroneous inferences are frequently deduced from the reported decisions, which decisions, however correct with reference to the class of agents embraced therein, will often be found to mislead, unless taken with the implied and tacit qualifications applicable to that peculiar class of agency." The business of the real estate agent is of modern growth. It has developed since most of the text-books on agency were written, and adjudications growing out of the relation which the real estate agent sustains to his principal and third persons have not been fully formulated.
