Reform in education has focused mainly on development of new programs and procedures to increase the achievement of the student in the classroom. Teacher evaluations are now based on how students perform in their classrooms on yearly standardized tests. The advent of integrating students with special needs into the regular classroom has brought both benefits and concerns for average and above average students. Special education in the United States has evolved from institutional and segregated environments to inclusion in the regular education classrooms. My book explores my personal experiences working with a therapy dog in three different school settings over a 7-year period. It is the position of the National Association of School Nurses (NASN) that registered school nurses (hereinafter referred to as school nurses) are integral to the team planning process necessary to successfully integrate "service animals" into schools. A request to bring a service animal into the school setting presents questions due to the complex disability discrimination laws, emerging medical and psychological data concerning service animal benefits (Winkle, Crowe & Hendrix, 2012), various interpretations of what criteria to use to distinguish between a trained service animal and a household pet, and potential effects on other students and staff. School nurses assess, plan, and coordinate care to develop an Individualized Healthcare Plans (IHP) for students with special healthcare needs, including students who may require the use of a service animal during the school day. Just as a student may need a wheelchair or other adaptive device, service animals are essential to some students' ability to be at school. School nurses are leaders in the development and evaluation of school health policies and programs that address the health and safety needs of students in the school environment (ANA & NASN, 2011). This Article focuses on the issue of whether a child with a disability has the legal right to attend a primary or secondary school with a service animal. It begins by setting forth basic information regarding the children who are currently receiving special education services and discussing the increasing number of animals placed into service with individuals under the age of eighteen, focusing on the recent trend of utilizing service animals to assist children with an autism spectrum disorder. Studies relating to the common argument against allowing service animals in schools - the impact of service animals on others with allergies to animal dander - are then examined. The Article continues with a brief summary of the federal law to provide a platform for analysis of the major cases in this area. As state laws that expand the rights of students appear to be an effective tool in litigation in this area, several of these laws are evaluated along with descriptions of language likely to be found in school district policies. State laws providing for trainers of service animals to have access to public accommodations, including schools, are then analyzed. The Article concludes by arguing that school districts need to be prepared with policies that provide for compliance with the law while still considering the impact of such animals on the school environment generally, given the legislative trends in this area.
