La sinistralité sans cesse croissante en matière de circulation routière remet à l'ordre du jour, l'épineux problème de la réparation des dommages consécutifs. Dans la recherche de solutions adaptées, douze Etats africains de la zone franc, inspirés par le modèle français, vont, dans le cadre du traité du 10 juillet 1992 instituant une organisation intégrée de l'industrie des assurances, organiser le régime d'indemnisation des victimes d'accidents de la circulation. En effet, il y est question de responsabilité du fait des véhicules terrestres à moteur mise en jeu par la seule participation matérielle desdits véhicules. L'indemnisation des dommages corporels et matériels, garantie par l'assurance automobile obligatoire ou, le cas échéant, par le fonds de garantie automobile, est harmonisée par l'application des barèmes et plafonds légaux. Par souci de rapidité et d'efficacité, ce droit à la réparation s'exerce dans le cadre de deux procédures légalement définies : la transaction et la procédure judiciaire. A l'issue de ce processus, le préjudice de la victime devrait être réparé. Mais le bilan est plutôt mitigé. Si la rationalisation du système d'indemnisation concoure à l'équilibre technique des compagnies d'assurances, garantes de la réparation, le renforcement de la protection des victimes n'est pas satisfaisant. En outre, l'exclusion de la victime, en cas d'accidents sans tiers responsable, du bénéfice de l'assurance automobile obligatoire et pire encore, le défaut de fonctionnalité du fonds de garantie automobile rendent impossible la prise en charge de certaines victimes. Ces écueils justifient que l'organe législatif de la CIMA revoie sa copie. Des états généraux sur les dix années du traité seraient l'occasion de procéder aux réajustements nécessaires.

The Workshop on the Indemnification of Damage in the Event of a Nuclear Accident, organised by the OECD Nuclear Energy Agency in close so-operation with the French authorities, was held in Paris from 26 to 28 November 2001. this event, which was an integral part of the International Nuclear Emergency Exercise INEX 2000, attracted wide participation from national nuclear authorities, regulators, operators of nuclear installations, nuclear insurers and international organizations. The objective was to test the capacity of the existing nuclear liability and compensation mechanisms in the 29 countries represented at the workshop to manage the consequences of a nuclear emergency such as the accident simulated at the Gravelines nuclear power plant in the north of France in May 2001, and upon which the INEX 2000 Exercise was based. These proceedings contain a comparative analysis of legislative and regulatory provisions governing emergency response and nuclear third party liability, based upon country replies to a questionnaire, the full responses provided to that questionnaire, as well as the texts of presentations made by special quests from Germany and Japan describing the manner in which the public authorities in their respective countries responded to two nuclear accidents of a very different nature and scale.
