Se è indubbiamente vero, con Adolf Merkl, che la caratteristica strutturale dello Stato di diritto, come venutosi a formare nel diciannovesimo secolo in poi, è da individuarsi nella estensione delle regole del processo all’esercizio dell’attività amministrativa ; questo appare confermato dalla convergente notazione che anche il processo amministrativo, nato da una costola dell’amministrazione stessa, nella sua struttura si sia sempre più avvicinato a quella che caratterizza il processo civile, modellandosi nella propria conformazione. Una convergente valutazione – tanto per fare un ulteriore esempio – si trova nella nota prolusione patavina di Enrico Guicciardi del 1936, ove appunto evidenziava che la legge del 1889 non aveva fatto altro che circondare delle garanzie proprie del procedimento giurisdizionale quello stesso tipo di reclamo che il cittadino poteva presentare, soltanto in linea amministrativa, ai sensi dell’art. 3 della legge del 1865. Così si è realizzata – come è davanti agli occhi di tutti – una progressiva assimilazione della giustizia amministrativa al processo civile, tale da lasciar immaginare che questa evoluzione si sia conclusa nella piena ed integrale formazione di un vero e proprio diritto processuale amministrativo, che affianca nella propria piena legittimazione e con pari dignità i fratelli maggiori, il diritto processuale civile e il diritto processuale penale. Il codice del processo amministrativo non ha fatto altro che porre il sigillo definitivo su questa evoluzione.
