This book deals with the implementation of the rights of the child as enshrined in the Convention on the Rights of the Child in 21 countries from Europe, Asia, Australia, and the USA. It gives an overview of the legal status of children regarding their most salient rights, such as the implementation of the best interest principle, the right of the child to know about of his/her origin, the right to be heard, to give medical consent, the right of the child in the field of employment, religious education of children, prohibition of physical punishment, protection of the child through deprivation of parental rights and in the case of inter-country adoption. In the last 25 years since the Convention on the Rights of the Child was adopted, many States Parties to the Convention have made great efforts to pass legislation regulating the rights of the child, in their commitment to the improvement of the legal status of the child. However, is that enough for any child to live better, safer, and healthier? What are the practical effects of this international as well as many national instruments in the everyday life of children? Have there been any outcomes in terms of improvement of their status around the world, and improvement of the conditions under which they live, since the Convention entered into force? L’ampleur des enjeux humains, économiques et sociaux posés par la question des solidarités entre générations a conduit l’International society of Family Law (ISFL) à choisir ce thème pour son XVe congrès mondial. Plus de 200 intervenants, venus de 50 pays, ont abordé ces questions sous l’angle juridique, mais aussi philosophique, économique et anthropologique. Cet ouvrage présente une partie de ces communications organisées autour de deux grands thèmes : l’enfant au cœur des solidarités familiales et la prise en charge des aînés par la famille. The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. This book focuses on African childhood and youth within the context of development and socialization where children are expected to be moulded in the image of adults. In many African societies children are generally held as passive bearers of the demands of adults, regardless of the fact that they are often exposed to a multitude of challenges that originate from the capriciousness of those adults. However, buoyed by international conventions and national legislations that offer them greater protection, and the ubiquitous internet that exposes them to childhood and youth experiences elsewhere, many of them are increasingly becoming assertive in homes, schools, and communities as well as re-invigorating their survival and self-preservation instincts. It is in this regard that this book, through the various chapters, engages with their competencies, skills and creativity to respond to experiential challenges as independent migrants or ones under coercion working in city streets and markets or cocoa farms or juggling work and schooling in pursuit of some education. Confronted with their parents and siblings health predicaments and the inadequacies of state and familial care, or urgent negotiation of their sexualities, they demonstrate incredible resilience. Similarly, their perceptiveness is demonstrated in a unique appreciation of politics and its actors and a capacity to assume responsibilities beyond their chronological age. Thus while highlighting some of the challenges confronting African children, the book provides gripping evidence of how they resiliently negotiate those challenges.
