This book addresses the forms of legal protection extended to people displaced due to the consequences of climate change, and who have either become refugees by crossing international borders or are climatically displaced persons (CDPs) in their own homelands. It explores the legal response of the South Asian Jurisdictions to these refugee-like situations, and also to what extent these people are protected under current international law. The book critically examines and assesses whether States have obligations to protect people displaced by climate change under international refugee law (IRL) and international climate change law (ICCL). The progress of SAARC is more evident in the less controversial areas of human security, such as poverty alleviation, health and safety, human resources development, and higher education. Notwithstanding enthusiastic commitments reflected in agreements and action plans, there is a gulf between rhetoric and implementation most notably in sensitive areas relating to traditional security. In the light of the findings of this study, the author proposes that greater cooperation in common human security areas has a potential to pave the way for a cooperation on issues of a ’contentious’ nature, particularly terrorism.

This book contributes to a better understanding of the relationship between migration, vulnerability, resilience and social justice associated with flooding across diverse environmental, social and policy contexts in Southeast Asia. It challenges simple analyses of flooding as a singular driver of migration, and instead considers the ways in which floods figure in migration-based livelihoods and amongst already mobile populations. The book develops a conceptual framework based on a ‘mobile political ecology’ in which particular attention is paid to the multidimensionality, temporalities and geographies of vulnerability. Rather than simply emphasising the capacities (or lack thereof) of individuals and households, the focus is on identifying factors that instigate, manage and perpetuate vulnerable populations and places: these include the sociopolitical dynamics of floods, flood hazards and risky environments, migration and migrant-based livelihoods and the policy environments through which all of these take shape. Neel Ahuja tracks the figure of the climate refugee in public media and policy over the past decade, arguing that journalists, security experts, politicians, and nongovernmental organizations have often oversimplified climate change and obfuscated the processes that drive mass migration. To understand the systemic reasons for displacement, Ahuja argues, it is necessary to reframe climate disaster as interlinked with the history of capitalism and the global politics of race, wherein racist presumptions about agrarian underdevelopment and Indigenous knowledge mask how financial, development, migration, and climate adaptation policies reproduce growing inequalities. Drawing on the work of Cedric Robinson and theories of racial capitalism, Ahuja considers how the oil industry transformed the economic and geopolitical processes that lead to displacement. From South Asia to the Persian Gulf, Europe, and North America, Ahuja studies how Asian trade, finance, and labor connections have changed the nature of race, borders, warfare, and capitalism since the 1970s.
