The economic dimension of conflicts has enjoyed increasing attention in research dealing with the dynamics of contemporary conflict. The nexus between natural resources, economics and conflict has played a defining role in a number of Africa's most intractable conflicts during the 1990s and early 2000s. The underlying assumption of this study is that the economic dimension of conflict can be hugely informative in terms of an understanding as to why peace agreements fail and in that sense can contribute to the resolution of conflicts if taken into account during the formulation of peace agreements. This study explores the ways in which conflict theory has dealt with the conflict-economics nexus, analyzing the extent to which theory illuminates the conflict reality in the Democratic Republic of Congo (DRC) during the period August 1998 to August 2004. It determines to what degree peace agreements in the DRC have taken the economic dimension and insights gained from the academic exploration of this topic into account during the negotiation and formulation of these agreements. In conclusion the study proposes a number of recommendations in terms of the peace process in the DRC with possible wider application for other peace agreements.

The involvement of up to 20 different parties and the various interests that occur might else be found only in the complexity of the 30 Years’ War of 17 th century Europe. Indeed many parallels exist between these two wars except maybe the fact that the former one can be regarded as war of state-building while the war in the DRC can be regarded as a state-collapsing war (van Crefeld 1999: 223-251). Due to the number of African countries involved, the estimated loss of 2,000,000 lives (Tshiyembé 2003), the complex role of economy, and the mere size of the country, it seems sad but true that ‘peace on the African continent cannot become a reality until there is peace in the DRC’ (Guéhenno 2002: 78). When considering such a conflict it is crucial to analyze the root causes of the conflict, even if they lie in the past, because these are necessary for understanding and addressing the conflict. Therefore a large part of this report will deal with historic, economic and systemic analysis.

This book analyses the way in which international human rights law (IHRL) and international investment law (IIL) are deployed – or fail to be deployed – in conflict countries within the context of natural resources extraction. It specifically analyses the way in which IIL protections impact on the parallel protection of economic, social and cultural rights (ESC rights) in the host state, especially the right to water. Arguing that current responses have been unsatisfactory, it considers the emergence of the 'Protect, Respect and Remedy' framework and the Guiding Principles for Business and Human Rights (jointly the Framework) as a possible analytical instrument. In so doing, it proposes a different approach to the way in which the Framework is generally interpreted, and then investigates the possible applicability of this 'recalibrated' Framework to the study of the IHRL-IIL interplay in a host country in a protracted armed conflict: Afghanistan. Through the emblematic example of Afghanistan, the book presents a practical dimension to its legal analysis. It uniquely portrays the elusive intersection between these two bodies of international law within a host country where the armed conflict continues to rage and a full economic restructuring is taking place away from the public eye, not least through the deployment of IIL and the inaction – or merely partial consideration – of IHRL. The book will be of interest to academics, policy-makers, and practitioners of international organisations involved in IHRL, IIL and/or deployed in contexts of armed conflict.

The macroeconomic and budget framework has been developed to take into account the effects of sectoral policies to maintain macroeconomic stability, a necessary condition for laying the foundation of economic growth and poverty reduction. It is based on the profile of public spending, the assessment of costs for achieving the Millennium Development Goals by 2020, and the sector-based economic growth theories taking into account the uncertainties of the international environment and the real potential of the Congolese economy. It is found that it allows for a realistic programming of public spending while highlighting the main budgetary choices proposed by the government.

In the aftermath of an armed conflict in Africa, the international community both produces and demands from local partners a variety of blueprints for reconstructing state and society. The aim is to re-formalize the state after what is viewed as a period of fragmentation. In reality, African economies and polities are very much informal in character, with informal actors, including so-called Big Men, often using their positions in the formal structure as a means to reach their own goals. Through a variety of in-depth case studies, including the DRC, Sierra Leone and Liberia, this comprehensive volume shows how important informal political and economic networks are in many of the continent’s conflict areas. Moreover, it demonstrates that without a proper understanding of the impact of these networks, attempts to formalize African states, particularly those emerging from wars, will be in vain.
