"This report assesses existing water market mechanisms (such as water banking and auctions) and partnership opportunities that Army installations can potentially use to improve installation water programs and their investments in water and wastewater systems. Because such mechanisms and opportunities depend on water management practices and water rights, the report also provides an overview of these areas. In addition, the report provides examples from across the United States, along with detailed case studies of these issues within Colorado and Fort Carson and within Arizona and Fort Huachuca. Water management today faces some key challenges, including aging infrastructure, water quality concerns, depleting groundwater aquifers, uncertain water supplies, pressures of population growth, climate change effects on water availability, and continued public demands for low-cost water. The traditional way of solving water problems -- by increasing access to new surface water and groundwater supplies--is often no longer viable. Such water sources are mostly allocated, and in many cases over-allocated. Today, many water managers are focused on conservation, efficient management, and accessing alternative water sources (such as treated wastewater and stormwater runoff). Water markets and partnerships are also being used in select cases. Conventional environmentalist thought is suspicious of private markets and property rights. The prospect of global climate change, and consequent ecological disruptions, has fueled the call for additional limitations on private markets and property rights. This essay, written for the Environmental Law Symposium on 21st Century Water Law, presents an alternative view. Specifically, this essay briefly explains why environmental problems generally, and the prospect of changing environmental conditions such as those brought about by climate change in particular, do not counsel further restrictions on private property rights and markets. To the contrary, the prospect of significant environmental changes strengthens the case for greater reliance on property rights and market institutions to address environmental problems, such as the management of fresh water resources.

Water management plays an increasingly critical role in national and international policy agendas. Growing scarcity, overuse, and pollution, combined with burgeoning demand, have made socio-political and economic conflicts almost unavoidable. Proposals to address water shortages are usually based on two key assumptions: (1) water is a commodity that can be bought and sold and (2) “states,” or other centralized entities, should control access to water. Liquid Relations criticizes these assumptions from a socio-legal perspective. Eleven case studies examine laws, distribution, and irrigation in regions around the world, including the United States, Nepal, Indonesia, Chile, Ecuador, India, and South Africa. In each case, problems are shown to be both ecological and human-made. The essays also consider the ways that gender, ethnicity, and class differences influence water rights and control. The vital importance of water to human activity is such that most societies and cultures have sought to establish legal rules over its use and allocation. In most jurisdictions legal rights to water have been linked to land tenure and ownership rights. A number of countries have recently undertaken substantive water law reforms, usually involving the introduction of formal and explicit water rights that clearly specify the volume of water that is subject to each right ("modern water rights"), together with institutional arrangements for their allocation, registration, monitoring and enforcement. Modern water rights are not intrinsically tied to specific land plots, are often transferable and available to be traded on a temporary or permament basis. This book reviews international experiences of the introduction and use of modern water rights. It is based on a survey of relevant primary and secondary legislation, published literature, internet sources and practical experience.
