"Data is emerging as a key component of military operations, both on and off the battlefield. Large troves of data generated by new information technologies-often termed "big data"-are growing ever more important to a range of military functions. Military forces and other actors will increasingly need to acquire, evaluate, and utilize such data in many combat contexts. At the same time, those forces can gain advantages by targeting adversaries' data and data systems. And a multitude of actors within armed conflict, including humanitarian and human rights organizations, can also use big data to deliver aid or identify atrocities. Such myriad uses of big data raise challenging interpretive questions under international humanitarian law (IHL), the jus ad bellum, and international human rights law. This book is the first of its kind to examine how these bodies of international law might apply to the uses of big data specifically. This book addresses issues of legal and moral governance arising in the development, deployment, and eventual uses of emerging technologies in military operations. Proverbial wisdom has it that law and morality always lag behind technological innovation. Hence, the book aims to identify, enumerate, and constructively address the problems of adequate governance for the development, deployment, and eventual uses of military technologies that have been newly introduced into military operations or which will be available in the near future. Proposals for modifications in governance, the book argues, closely track the anxieties of many critics of these technologies to the extent that they will proliferate, prove destructive in unanticipated ways, and partially or wholly escape regulation under current treaties and regulatory regimes. In addition to such concerns in domestic and especially in international law, the book addresses ethical norms in the professions involved in the design and eventual use of specific technologies, principally involving the professional norms of practice in engineering and the military (as well as biomedical and health care practice), which impose moral obligations on their members to avoid reckless endangerment or criminal negligence in the course of their activities. This document summarizes the main findings and implications of the first empirical study investigating the scale and scope of arms trafficking on the dark web, which was conducted by RAND Europe and the University of Manchester from September 2016 to July 2017. There is an ongoing debate over the extent to which online black markets on the so-called "dark web," the part of the Internet not searchable by traditional search engines and hidden behind anonymity software, facilitate arms trafficking. Details have emerged in the media following the Munich shooting in 2016 linking the weapons used by the attacker to vendors on dark web marketplaces (also known as cryptomarkets). Some media reports have also linked the Paris terrorist attacks in November 2015 to these platforms. While these reports appear to have raised concerns about the role of such dark web markets in arms trade, evidence on the subject is largely anecdotal, based on secondary data as reported after events such as terrorist attacks or successful law enforcement operations.
