The study of civil-military relations in Latin America produced a rich debate and research agenda prior to 2000. But this agenda was largely abandoned during the past decade as the spectre of military dictatorship has virtually disappeared, with the political role of the military in many countries dramatically diminished. Indeed, in no country that has initiated a process of holding the military accountable to civilian control has the military openly rebelled. Yet, the institutions and public attitudes that guarantee democratic civilian control of the military exist in a general context of political polarisation, citizen insecurity and in many countries a sense of developing ungovernability. The military coup in Honduras (2009), the military response to the police rebellion in Ecuador (2010), and the speculation concerning the Venezuelan military's behaviour in the event that Hugo Chavez is incapacitated or dies (2013), demonstrates the relevance and importance of the civil-military relationship today. In this volume leading scholars from Latin America, the U.S. and Spain debate the ability of contemporary Latin American civil-military relationships to weather these challenges. The authors examine new types of regimes (the rise of participatory democracy), new political orientations (the renaissance of the Left in Latin America), and new missions for the military. Debate centres on the indicators to evaluate the level of consolidation of civilian control, the manner in which these indicators are measured, and the empirical ambiguities that arise. These challenges must be confronted in order to effectively address the question of how much progress has been made in the region in subordinating the military to civilian control, which countries are lagging behind, and why. For centuries, the Spanish state has proved to be an expert system for repressing political dissent and any threat that could jeopardize the maintenance of the status quo. It has done so using all the institutions and all the areas of power that were necessary, for the end has always justified the means. Carles Mundo, Catalan Minister of Justice, 2016-2017. There is no book in Spain that talks about lawfare. Nor is there a book that deals with the system of judicial repression of political dissidence deployed by the Franco regime. Nor is there a book that denounces the judicial system inherited from the dictatorial regime and that was later embodied in the 1978 Constitution. Lawfare (the combination of law and warfare) thus fills a void to the extent that it penetrates the authoritarian judicial system and highlights the democratic deficits of the Spanish judiciary. The politicization of justice began with the appointment, as president of the Constitutional Court, of a prominent member of the Peoples Party (Partido Popular PP) in 2013. Thereon started a process of judicialization of politics via reform of the Organic Law of the Court Constitutional. The referendums of November 9, 2014 and October 1, 2017 entailed the criminalization of the Catalan independence movement and a drastic reduction in fundamental rights linked to the exercise of political choice. This was confirmed by the judgment handed down by the Supreme Court in 2019, culminating in a lawfare strategy that has led to the criminal conviction of two presidents of the Generalitat Artur Mas and Joaquim Torra and the exile of a third president, Carles Puigdemont. Lawfare is the first book to link in a broad way the thinking of German jurists of the Nazi period to the training of judges in Spain both up to and during the Franco regime, and beyond. A wide-ranging examination of the ways digital technologies are impacting Cuba’s Revolutionary project The triumph of the Cuban Revolution gave the Communist Party a monopoly over both politics and the mass media. However, with the subsequent global proliferation of new information and communication technologies, Cuban citizens have become active participants in the worldwide digital revolution. While the Cuban internet has long been characterized by censorship, high costs, slow speeds, and limited access, this volume argues that since 2013, technological developments have allowed for a fundamental reconfiguration of the cultural, economic, social, and political spheres of the Revolutionary project. The essays in this volume cover various transformations within this new digital revolution, examining both government-enabled paid public web access and creative workarounds that Cubans have designed to independently produce, distribute, and access digital content.
