Constitutional law, international law, military law and political science are among the primary topics of this collection of writings, essays and speeches, some previously unpublished. One will also find several interesting pieces on educational policy, studies of Washington, Napoleon, Alexander von Humboldt, and Barthold George Niebuhr and a reminiscence of the Battle of Waterloo. With an introduction by Johann Caspar Bluntschli [1808-1881], the noted Swiss scholar of constitutional and international law, and a chronological list of Leiber's writings. FRANCIS LIEBER [1798-1872] was a prominent political philosopher and who helped lay the foundation for the study of political science in the United States. Renowned for his theory of civil liberty which combined an appreciation for the English concept of decentralized political institutions that protected the rights of the individual with the German idea of an overall national purpose, he bridged the intellectual gap between Europe and America. A Prussian scholar and political activist who was imprisoned twice in Germany for his liberalism, he was one of the first university-trained scholars to emigrate to the United States. A scholar of wide interests beyond law and politics, he published studies on economics, statistics, education and penal reform and produced and edited the Encyclopedia Americana, the first work of its kind published in the United States. He became professor of history and political economy at South Carolina College, and was later appointed to the same chair at Columbia College. In 1865 he moved to Columbia Law School, where he was renowned for his contributions.

This book, which represents probably the most comprehensive discussion of the emergence of modem social science yet produced, is of far more than merely historical interest. The contributors set out to rewrite the history of the social sciences and to show the limitations of conventional conceptions of their development. These tasks they accomplish with great success and much distinction. Yet in so doing they contribute in a direct way to our understanding of the relation between social analysis and the nature of human societies today. The brilliant and distinctive perspective of the papers in this collection is to demonstrate, with many specific examples, that social science and modem institutions have helped shape each other in mutual interplay. Modem systems are in some part con stituted through the reflexive incorporation of developing social science knowledge; on the other hand, the social sciences organise themselves in terms of a continuing reflection upon the evolution of those systems. Such a perspective, as Wagner and Wittrock in particular make clear, does not in any way either impugn the status of knowledge claims made within social science or destroy the independent reality of social institutions. The book questions the notion that the institutionalising of the social sciences can be understood as a process of their increasing autonomy from extemal social connections. Richards, is the attempt to understand the implications of the Reconstruction Amendments--Amendments Thirteen, Fourteen, and Fifteen to the United States Constitution. Richards evaluates previous efforts to interpret the amendments and then proposes his own view: together the amendments embodied a self-conscious rebirth of America's revolutionary, rights-based constitutionalism. Building on an approach to constitutional law developed in his Toleration and the Constitution and Foundations of American Constitutionalism, Richards links history, law, and political theory. In Conscience and the Constitution, this method leads from an analysis of the Reconstruction Amendments to a broad discussion of the American constitutional system as a whole. Richards's interpretation focuses on the abolitionists and their radical commitment to the "dissenting conscience." In his view, the Reconstruction Amendments expressed not only the constitutional arguments of a particular historical period but also a general political theory developed by the abolitionists, who restructured the American political community in terms of respect for universal human rights. He argues further that the amendments make a claim on our generation to keep faith with the vision of the "founders of 1865." In specific terms he points out what such allegiance would mean in the context of present-day constitutional issues. Originally published in 1993.
