Book Description
Excerpt from The Contract of Sale in the Civil Law: With References to the Laws of England, Scotland and France His Honour Judge Chalmers, that there is hardly a judg ment of importance on the law of Sale in which reference is not made to it.' At the same time, for the convenience of those who from choice or necessity may desire to study the original, I have printed at the end of the book the two Titles in the Digest (xviii. I and xix. I) which bear most directly on the subject, and which are usually prescribed, in connection with it, in examinations, and I have prepared a kind of Index which shows the references in the body of the work to most of the other Titles in the Corpus Iuris which relate to this contract. N o attempt has been made to trace the historical evolution of the law of Sale. What was its actual origin, as a con sensual contract, in the Roman system is a question of very great interest, which has been investigated by some of the most learned and penetrating of the historical jurists on the Continent, and which has engaged others, both there and in England, in speculations which have hitherto led to no very satisfactory results. Until some sure ground has been reached it would be foolish to discuss such a matter in a book which it is intended and hoped will be of real use to lawyers in this country, and accordingly I have in the main contented myself with setting forth the principles of the contract, as they are to be found in the Code, Digest and Institutes, although I have not refrained from historical disquisition where the actual origin of a rule is known beyond all question. Book Description
Excerpt from A Treatise on the Effect of the Contract of Sale on the Legal Rights of Property and Possession in Goods, Wares, and Merchandise In preparing, with Lord Blackburn's kind permission, a second edition of this work, I felt it important that the reader should be able to see at a glance what, in all material respects, were the words of the original text. I have therefore endeavoured clearly to distinguish, by the use of brackets, wherever I have deemed it necessary to do so, all new matter which has been introduced either by way of addition or alteration and for which I am alone responsible. The whole of the Chapters on "Equitable Interests and Assignments," on "Damages," and on "Interest," are my own, as well as a considerable portion of that on "Conditions Precedent" and the "Remedies of the Parties." I take, with pleasure, this opportunity of thanking my friends of the Middle Temple, Mr. A. V. Blumberg, and Mr. R. W. Wallace, for help kindly given me in the task of correcting the proof sheets. My thanks are also more particularly due to Mr. C. H. L. Neish, Mr. Lionel Goodrich, and Mr. F. H. Salusbury, for much general assistance, and especially to Mr. S. J. Fraser Macleod for much valuable criticism and assistance in the preparation of the Chapter on Equitable Interests and Assignments. Book Description
Excerpt from Hand-Book of the Law of Sales The object of this handbook is to present concisely the general principles of the law of the sale of personal property. The arrange ment is in the main that of Benjamin. The statement of rules and principles in the black-letter text has to a considerable extent, though with many modifications, necessitated by the difierences between the American and English law, or by other reasons, been taken from the English Sale of Goods Bill, as drafted by his Honor, Judge Chalm ers, and published together with his invaluable notes under the title of The Sale of Goods. This bill, which was purely a codify ing measure, has since been substantially enacted as An act for codifying the law relating to the sale of goods (56 57 Vict. C. 71; February 20, The writer has made frequent use both of the notes of Judge Chalmers and of the text of Benjamin on Sales. The references to Benjamin are to the sections as found in the sixth American edition, of Messrs. Edmund H. And Samuel 0. Bennett.
