Excerpt from Constitutional History of France The author of this essay has made some attempt briefly to outline the intellectual, social, and political causes which led to the changes in the form of government of France, and at the same time to sketch the salient features of her organic law. Parliamentary governments, like that of Great Britain, and presidential systems, similar to that of the United States, have been compared to the parliamentary Republic of France. Such an extended period of French history has been dealt with that it has only been possible to accord a brief consideration to the many questions of Constitutionalism, which would, under other circumstances, have received a closer analysis than the cursory one which the author has made. However, it was intended to produce a general commentary and criticism, and reference is therefore invited to the Constitutional laws which have been translated and placed in the. appendix of this work, in support of the positions assumed. Although the Constitutional life of France lies within the period treated in this essay, still it is true that as early as the time that immediately followed the Middle Ages, society revived and secured popular franchises from the Crown and the nobles. Excerpt from The Constitutions: And Other Select Documents Illustrative of the History of France 1789-1901 The practice of studying documents in connection with the history courses given in American universities, colleges, and high schools has now become so general, and the results attained so satisfactory, that the method no longer requires any defence. With the introduction of the system has come a new kind of manual, the document look. So many excellent books of this description have already appeared that the editor of still another may be reasonably expected to offer an adequate explanation for its publication. Three considerations have induced me to prepare this volume. The first of these is personal and local. For several years past I have made a practice of dividing my class in modern European history into small sections which I could meet once each week around the seminary table. At these meetings we have studied together a considerable part of the documents here included, but the work has been hampered by the lack of a convenient collection of the documents. Fidelity to the interest of my pupils seemed to impose upon me the obligation to remove this difficulty. The second consideration lies in the attractiveness of the documents. After considerable experience in the use of various classes of documents upon European history I have reached the conclusion that students find the modern French documents more attractive than any others. Doubtless the chief reasons for this preference are that modern documents arc more easily comprehended than those of more remote periods and that the style of the French is superior to that of English and German documents. Since documentary study must usually be confined to a small part of the field traversed by a class, I believe that for classes in modern European history the preference of the students may well be allowed to control the selection of the period to be studied. The third consideration is the importance of the field covered. The history of France since the beginning of the revolution surely deserves a volume in English presenting as large a proportion as possible of the important documents. Excerpt from The Essentials of a Written Constitution Aristocracy and democracy, in the political sense, it will be noticed, are merely relative terms. There is no exact point at which a community ceases to be aristocratic and becomes democratic, and it is quite obvious that a community may be aristocratic as respects a second and at the same time democratic in relation to a third. France under the Orleans monarchy vested supreme political power in some voters, while under the second empire there were More than one of the states of our Union at the outset had suffrage laws so restrictive in character that they were decidedly aristocratic as compared with their present status, although undoubtedly democratic in comparison even with France under Louis Philippe. An organized political community, independent of external control, is commonly called a state. There is, however, often a confusion of thought arising from the more or less unconscious use of the term state in two different senses. These two applications of the term should be sharply distinguished, and the distinction kept always in mind. In the larger sense the state includes the whole community living in a given terri tory and subject to the political authority of its government. In the limited sense the state includes only that portion of the community which has political authority over the whole, and whose agent in the exercise of that authority is the government. The state in the larger sense we may, for convenience, call the social state. The other may be called the political state. The members of the social state are all subject to law. The political state creates law and enforces it. Political power belongs to the political state, to be sure, for the protection and welfare of the social state.
