The dichotomy be tween summary and plenary jurisdiction, which has been productive of endless and pointless litigation, would disappear. All actions to which a trustee is a party will lie in the bankruptcy court. Possession of the property of the estate by some one other than the bankrupt - even custody by some other court - will not be a limitation on the bankruptcy court's jurisdiction. This allocation of judicial responsibility should permit expeditious disposition of litigation arising out of bankruptcy and reorganization cases and should terminate the game playing that goes on now in connection with the choice of forums for various categories of controversies and proceedings under the Bankruptcy Act.
