This open access monograph argues established democratic norms for freedom of expression should be implemented on the internet. Moderating policies of tech companies as Facebook, Twitter and Google have resulted in posts being removed on an industrial scale. While this moderation is often encouraged by governments - on the pretext that terrorism, bullying, pornography, "hate speech" and "fake news" will slowly disappear from the internet - it enables tech companies to censure our society. It is the social media companies who define what is blacklisted in their community standards. And given the dominance of social media in our information society, we run the risk of outsourcing the definition of our principles for discussion in the public domain to private companies. Instead of leaving it to social media companies only to take action, the authors argue democratic institutions should take an active role in moderating criminal content on the internet. To make this possible, tech companies should be analyzed whether they are approaching a monopoly. Antitrust legislation should be applied to bring those monopolies within democratic governmental oversight. How Brazilian favela residents engage with and appropriate technologies, both to fight the oppression in their lives and to represent themselves in the world. Brazilian favelas are impoverished settlements usually located on hillsides or the outskirts of a city. In Technology of the Oppressed, David Nemer draws on extensive ethnographic fieldwork to provide a rich account of how favela residents engage with technology in community technology centers and in their everyday lives. Their stories reveal the structural violence of the information age. But they also show how those oppressed by technology don’t just reject it, but consciously resist and appropriate it, and how their experiences with digital technologies enable them to navigate both digital and nondigital sources of oppression—and even, at times, to flourish. Nemer uses a decolonial and intersectional framework called Mundane Technology as an analytical tool to understand how digital technologies can simultaneously be sites of oppression and tools in the fight for freedom. Building on the work of the Brazilian educator and philosopher Paulo Freire, he shows how the favela residents appropriate everyday technologies—technological artifacts (cell phones, Facebook), operations (repair), and spaces (Telecenters and Lan Houses)—and use them to alleviate the oppression in their everyday lives. He also addresses the relationship of misinformation to radicalization and the rise of the new far right. Contrary to the simplistic techno-optimistic belief that technology will save the poor, even with access to technology these marginalized people face numerous sources of oppression, including technological biases, racism, classism, sexism, and censorship. Yet the spirit, love, community, resilience, and resistance of favela residents make possible their pursuit of freedom.

Today, transparency is a widely heralded value, and the U.S. Freedom of Information Act (FOIA) is often held up as one of the transparency movement’s canonical achievements. Yet while many view the law as a powerful tool for journalists, activists, and ordinary citizens to pursue the public good, FOIA is beset by massive backlogs, and corporations and the powerful have become adept at using it for their own interests. Close observers of laws like FOIA have begun to question whether these laws interfere with good governance, display a deleterious anti-public-sector bias, or are otherwise inadequate for the twenty-first century’s challenges. Troubling Transparency brings together leading scholars from different disciplines to analyze freedom of information policies in the United States and abroad—how they are working, how they are failing, and how they might be improved. In How Machines Came to Speak Jennifer Petersen constructs a genealogy of how legal conceptions of “speech” have transformed over the last century in response to new media technologies. Drawing on media and legal history, Petersen shows that the legal category of speech has varied considerably, evolving from a narrow category of oratory and print publication to a broad, abstract conception encompassing expressive nonverbal actions, algorithms, and data. She examines a series of pivotal US court cases in which new media technologies—such as phonographs, radio, film, and computer code—were integral to this shift. In judicial decisions ranging from the determination that silent films were not a form of speech to the expansion of speech rights to include algorithmic outputs, courts understood speech as mediated through technology. Speech thus became disarticulated from individual speakers. By outlining how legal definitions of speech are indelibly dependent on technology, Petersen demonstrates that future innovations such as artificial intelligence will continue to restructure speech law in ways that threaten to protect corporate and institutional forms of speech over the rights and interests of citizens.
