Between 1995 and 2005, the government of Alberta undertook major reforms to the way water is governed in the arid southern part of the province. Among the most significant reforms was the imposition of moratoria on new water licenses, the introduction of a market for buying and selling existing water licenses, and the adoption of a “conservation holdback” mechanism for returning some licensed water to the environment. In Water Policy Reform in Southern Alberta, B. Timothy Heinmiller looks at how and why these (and other) reforms were adopted after nearly a century of stasis on water policy. The study analyses over three decades of policy decisions, beginning with the Progressive Conservative victory in 1972 to the last major policy reform in 2007. Applying the Advocacy Coalition Framework, process tracing methodologies, and content analysis, the author isolates, identifies and reconstructs the actors and processes that shaped over thirty years of water policy in Alberta. Fresh water is becoming an increasingly precious commodity. In the near future, control of it could lead to the type of political instability that is now associated with energy shortages. Global change possesses serious challenges for water managers and scientists. In mountain areas, where water supplies for half of the world population originate, climate and hydrologic models are still subject to considerable uncertainty. And yet, critical decisions have to be taken to ensure adequate and safe water supplies to billions of people, millions of farmers and industries, without further deteriorating rivers and water bodies. While global warming is known to cause glaciers’ retreat and reduced snow packs around the world, it is not clear that mountain discharge will be lower. What is widely recognised is that water management must be adapted to accommodate significant regime changes. However, this inevitably involves managing transboundary rivers, adding further complexity to putting principles in practice. This book takes global warming and the importance of mountain areas in world water resources as the starting point. First, it provides detailed reviews of the processes going on in several rivers systems and world regions in Europe (Rhône and Ebro), North America (Canadian Rockies, Western US and Mexico), the Middle East (Jordan), Africa (Tunisia, Kenya and South Africa). These contexts provide case studies and examples that show the difficulties and potential for adaptation to global change. Land-use, economics, numerous modeling approaches are some of the cross-cutting issues covered in the chapters. The volume also includes the views of water practitioners, with two chapters authored by members of the US-Canada International Joint Commission, an industrialist from Western Canada and an environmental leader in Spain. By combining a rich set of contexts and approaches, the volume succeeds in offering a view of the global challenges faced by water agencies, international donors and researchers around the world. A case is made in some chapters to seek adaptive strategies rather than trying to reduce or control resources variability. This requires factoring in land-use, social and economic aspects, especially in developing countries. Another conclusion is that complex problems can and must be posed and negotiated with the help of models, mapping techniques and science-based facts. However complex these may be, there are ways to translate them to easily interpretable and visualisations of alternative scenarios and courses of action. This book provides numerous examples of the potential of such approaches to draft environmental programmes solve transboundary disputes and reduce the economic consequences of droughts and climate instability.

River systems around the world are degraded and are being used unsustainably. Meeting this challenge requires the development of flexible regimes that have the potential to meet essential consumptive needs while restoring environmental flows. This book focuses on how water trading frameworks can be repurposed for environmental water recovery and aims to conceptualise the most appropriate role for law in supporting recovery through these frameworks. The author presents a comprehensive study of the legal frameworks in four jurisdictions: the States of Oregon and Colorado in the western United States; the province of Alberta in Canada; and the Murray-Darling Basin in Australia/Basin State of New South Wales. A close comparative analysis of these four jurisdictions reveals a variety of distinctive regulatory arrangements and collaborations between public and private actors. In all cases, the law has been deployed to steer and coordinate these water governance activities. The book argues that each regime is based on a particular regulatory strategy, with different conceptions of the appropriate roles for, and relationships between, various actors and institutions. Legal frameworks do not have the capacity to rationalise and provide an overarching and absolute solution to the complex environmental and governance issues that arise in the context of environmental water transactions. Rather, the role of law in this context needs to be reconceptualised within the paradigm of regulatory capitalism as establishing and maintaining the limits within which regulatory participants can operate, innovate and collaborate.

Growing scarcity of freshwater worldwide brings to light the need for sound water resource modeling and policy analysis. While a solid foundation has been established for many specific water management problems, combining those methods and principles in a unified framework remains an ongoing challenge. This Handbook aims to expand the scope of efficient water use to include allocation of sources and quantities across uses and time, as well as integrating demand-management with supply-side substitutes. Socially efficient water use does not generally coincide with private decisions in the real world, however. Examples of mechanisms designed to incentivize efficient behavior are drawn from agricultural water use, municipal water regulation, and externalities linked to water resources. Water management is further complicated when information is costly and/or imperfect. Standard optimization frameworks are extended to allow for coordination costs, games and cooperation, and risk allocation. When operating efficiently, water markets are often viewed as a desirable means of allocation because a market price incentivizes users to move resources from low to high value activities. However, early attempts at water trading have run into many obstacles. Case studies from the United States, Australia, Europe, and Canada highlight the successes and remaining challenges of establishing efficient water markets.
