The current development of fifth generation of mobile communications technology, known as 5G, has triggered intense discussions about proper spectrum assignment procedures to accommodate 5G spectrum needs (LStelcom et al., 2017). In particular, spectrum scarcity and lengthy processes to remove and relocate low-intensity uses have led to a renewed interest in spectrum sharing (PCAST, 2012). Since access to radio spectrum for the provision of commercial mobile communications services, mostly cellular telephony and wireless broadband access, is generally granted by means of exclusive usage rights, a growing stream of research is recognising efficiency gains of allowing spectrum to be shared, questioning the primacy of exclusive access to spectrum (Beltran, 2017). Against this background, this paper aims to discuss recent international attempts to introduce some forms of spectrum sharing for the assignment of spectrum rights for the fourth generation (4G) of mobile communications technology, in the light of current challenges posed by the fifth generation (5G). Recently, three cases have called or are calling for the award of rights to the shared use of the spectrum. These cases reveal the rationales supporting National Regulatory Authorities' (NRAs) decisions that led or will lead to the assignment of shared spectrum rights. Furthermore, they also reveal specific assignment methods - either proposed or not fully deployed, which this paper uses for its main contribution. The three cases considered for the analysis are: the 800 MHz and 2.6 GHz bands auction planned by the UK regulator in 2013; the Licensed Shared Access (LSA) approach defined by the European Union (EU); and the 3.5 GHz ecosystem developed in the United States (US). Using an analytical framework for the identification of the adequate spectrum management approach, this paper undertakes a comparison of the abovementioned three cases to draw lessons applicable to the upcoming 5G services.

This paper discusses two recent spectrum management frameworks, the Licensed Shared Access (LSA) developed in Europe and the Citizens Broadband Radio Services (CBRS) developed in the United States (US), which build their management approach on spectrum sharing. The importance of these two frameworks, besides their leading normative roles, is that recent debates have shaped them as cases to consider in the adoption of the upcoming fifth generation (5G) of mobile communications technology, in particular in the C-band. A discussion on these two frameworks is organised by following the four-step decision-making guide for spectrum management developed by Pogorel (2007), which requires spectrum authorities to make decisions in four areas of spectrum management: frequency harmonization, technology standardization, type of usage rights and assignment procedures. Notwithstanding the similarities with respect to the four areas of spectrum management considered, the two frameworks differ on their implementation schedules. CBRS leads the way, with a handful of providers receiving government approval to manage spectrum access controllers, and as of mid 2020, scheduled to have allocated spectrum licenses on half of its available spectrum. On the contrary, European countries have shown scarce interest towards implementing the LSA, despite the extensive work carried out by regulatory and standardization bodies. This may suggest that there are external contextual factors which influence the successful implementation of spectrum sharing frameworks. An interesting aspect which deserves further investigation is the institutional context in which decisions related to radio spectrum management are taken. Unlike the US authorities, European institutions do not possess coercive enforcement powers with respect to spectrum sharing. Spectrum management decisions made by the regulators aim at maximizing the value of spectrum, its efficient utilization and benefits to the society. A major debate in spectrum management globally is currently focusing on 5G spectrum bands and their awards. In fact, several countries have recently made their first 5G spectrum awards decisions, which will have a long-term impact on the mobile communication market. This paper analyses recent 5G spectrum decisions from the spectrum valuation view point and discusses the emerging role of local 5G networks to serve the needs of different vertical sectors. Special attention is put on the awarding and pricing of 5G spectrum and recommendations are given on new pricing mechanisms that take into account the emergence of local 5G networks by different stakeholders. The results highlight the divergence in the spectrum management approaches that the regulators in different countries have taken where the first 5G spectrum decisions have continued to strengthen the mobile network operator (MNO) market dominance while the most recent planned decision aim at opening the mobile market to new local entry through local spectrum access rights.
