Excerpt from Rural Zoning Enabling Acts of the Northern Great Plains States Zoning is a function of the police power of the state. It is a form of public control over the use of private property in the interest of general welfare. Zoning may be defined as the creation of legal districts ulthin.which regulations prohibit injurious or unsuitable structures and uses of land and buildings. The use of this power directly by the state is the exception rather than the rule. Usually the power is delegated to local political subdivisions which may or may not make use of the authority as they see fit. This delegation is by an enabling act which is adopted by the legislature. They are not particularized. Moreover, as commonly conceived zoning cperates prospectively. It has as its object to prevent the recurrence of certain mistakes of the past; and it normally reaches only to preventing the future establishment of the designated misuse. Zoning is not a euro-all, and does not in itself constitute an entire land-use program; but it is rather one of several regulative measures which together might constitute such a program. In certain instances zoning may be desirably used as a center around which the complete program can be built. In other cases, zoning can be more appropriately used as a complement to other land-use measures. In still other cases, zoning may not be necessary at all, for either one or both of two reasons: either the circumstances do not warrant it, or other more feasible measures might accomplish under the circum stances all that zoning could accomplish. When, to what extent, and how the interest of the public in the use of lands is to be protected depends on what the circumstances call for. Excerpt from A Treatise on the Limitations of Police Power in the United States: Considered From Both a Civil and Criminal Standpoint In the days when popular government was unknown, and the maxim Quod principi placuit, legis habet vigorem, seemed to be the fundamental theory of all law, it would have been idle to speak of limitations upon the police power of government; for there were none, except those which are imposed by the finite character of all things natural. Absolutism existed in its most repulsive form. The king ruled by divine right, and obtaining his authority from above he acknowledged no natural rights in the individual. If it was his pleasure to give to his people a wide room for individual activity, the subject had no occasion for complaint. But he could not raise any effective opposition to the pleasure of the ruler, if he should see fit to impose numerous restrictions, all tending to oppress the weaker for the benefit of the stronger. But the divine right of kings began to be questioned, and its hold on the public mind was gradually weakened, until, finally, it was repudiated altogether, and the opposite principle substituted, that all governmental power is derived from the people; and instead of the king being the vicegerent of God, and the people subjects of the king, the king and other officers of the government were the servants of the people, and the people became the real sovereign through the officials.
