This book analyses recent developments concerning the application of the international legal doctrines of recognition and self-determination in relation to the Western Sahara Question. It investigates the emergent shift in favour of Morocco’s sovereignty claim to Western Sahara as apparent from the positions adopted by an increasing number of third States in the United Nations and the recent spate of third States establishing consulates in Western Sahara, with Morocco’s encouragement. It reflects on what the functioning of the doctrines of recognition and self-determination in this situation reveals about contemporary international law in practice more generally. The principle of self-determination has at heart the achievement of true representation and democracy based on the idea that the consent of the governed alone can give government legitimacy. The principle was primarily responsible for the decolonisation process that shaped our current international community. `Self-determination' has been used in equal rhetorical brilliance by a number of leaders - some meritorious, with a genuine concern for human emancipation, others dubious, with ascendancy to power at the heart of their project. In any case, `self-determination' has come to mean different things in different contexts. Being a vital principle, especially in the post-colonial state, it is one factor that represents a threat to world order while at the same time holding out the promise of longer-term peace and security based on values of democracy, equity and justice. This book looks at the intricacies of the norm in its current ambiguous manifestation and seeks to deconstruct it with regard to three particularly inter-related discourses: that of minority rights, statehood and sovereignty, and the doctrine of uti possidetis which shaped the modern post-colonial state. These norms are then analysed further within two case studies. One, concerning the creation of Bangladesh where `self-determination' was achieved. The second, examines the situation in the Western Sahara where `self-determination' (whatever its manifestation) is yet to be expressed. In the course of these case studies we seek to highlight the problematic nature of `national identity' and the `self' in settings far removed from post-Westphalian Europe.

This paper aims to investigate the story of a country that was colonized by Spain, abandoned by Madrid, and subsequently claimed by Morocco. Spanish Sahara, now known as Western Sahara, is the territory in question. When Spanish Sahara was left by Spain to fend for itself in 1975, King Hassan of Morocco claimed sovereignty over it. King Hassan saw a potential "Greater Morocco", which, in his view, encompassed Morocco-proper and the former Spanish Sahara. Since becoming recognized as a non-self-governing territory, most of Western Sahara has been occupied by Morocco and much of its native population resides in Tindouf refugee camps. These camps, in neighboring Algeria, are home to an organized government body, the Saharawi Arab Democratic Republic, alongside the Polisario Front which has militarily resisted Moroccan occupation. Despite various attempts by the U.N. to hold a referendum on the independence of Western Sahara, such a vote has never happened. Disputes over qualified voters have completely halted the process, an especially convoluted point since the Green March in 1975, in which the Moroccan government enabled hundreds of thousands of Moroccans to march into Western Saharan territory. Morocco now controls some 80 percent of the territory behind a large wall barrier constructed by Moroccan forces and reinforced by American mine technology. Ban Ki-moon, the UN Secretary General, has called Moroccan presence in Western Sahara an occupation. This raises three questions: how has Moroccan diplomacy frustrated Saharawi independence, what options are still feasible as a solution, and how should the U.S. respond to the recent developments in this longstanding conflict?

This book gives a comprehensive background to the long running conflict on the status of Western Sahara and particularly highlights the question of the territory’s natural resources, such as fish, oil and phosphates. The book analyzes why this territory, (mainly covered by desert and only sparsely populated), has since 1976 when the former colonial power Spain left the territory, engaged governments and people, both regionally and internationally, and the implications of its natural resources. The book includes: - a summary of the Western Saharan conflict, by Pedro Pinte Leite, specialist in international law in the Netherlands; - an up-to-date picture of the situation in Western Sahara with regard to natural resources, and the way in which exploitation is taking place, by Toby Shelley, a British journalist; - the UN’s legal opinion from 2002 on exploitation of the natural resources of a Non-Self-Governing Territory written by Hans Corell, former UN Under-Secretary-General for Legal Affairs, the Legal Counsel. Two political views of the conflict are also included. Magnus Schöldtz and Pål Wrange from the Swedish Foreign Ministry elucidate the Swedish Foreign Policy on the Western Sahara Conflict.
