IV 1831, Both Inclusive Mr. Serjeant Heat's, in support of his rule, contended that the limited construction sought to be put upon the former part of the section, was not consistent with the lat ter part; and that, at all events, the conduct of the plain tifl' in misleading the defendant, entitled the latter to have the execution set aside. Per Cerium - Without giving any opinion upon the enactment in question, which is very obscurely worded, it is enough to say, that, upon the affidavits, sufficient ap pears to warrant the Court in setting aside the execution.
