Es hora, pues, de un Derecho global, como antes lo fue del Derecho de gentes y luego lo ha sido del Derecho internacional. Sin el ius gentium, no se entiende el Derecho inter nationes, el International Law. Y sin el desarrollo de éste, no hubiera nacido el incipiente Derecho global. This book explores the emergence of an ius puniendi outside state criminal law and beyond international criminal law. The study connects with the reflections that have been made for some years in global law studies, showing how this trend also has a clear manifestation in the field of criminal law. Creada por acuerdo entre esta universidad y la Fundación Garrigues en marzo de 2003, la Cátedra Garrigues de Derecho Global tiene por objeto el estudio de los efectos jurídicos de la globalización, así como la fundamentación de un Derecho global, configurador de un ordo orbis más justo, democrático y libre, basado, entre otros, en los principios de personalidad, igualdad, solidaridad, subsidiariedad, integración y autoridad. Ex Roma, ius contiene las primeras lecciones que, como director de la Cátedra Garrigues, me ha correspondido impartir a lo largo de 2004. El título elegido refleja bien una idea latente en todas ellas, a saber: que cualquier consideración teórica acerca del nuevo orden jurídico mundial debe hacerse a la luz de las fuentes del Derecho romano. En efecto, en mi opinión, es misión del ius Romanorum, en este siglo XXI, servir de puente entre los distintos sistemas jurídicos del mundo, y muy particularmente, hodie et nunc, entre el civil law y el common law. Estos dos grandes sistemas, sin duda distintos, no son paralelos, como se ha dicho, pues tienen un sólido fundamento común en el Derecho romano, que influyó de forma determinante, aunque con manifestaciones distintas, tanto en uno como en otro. Corresponde a los juristas del siglo XXI armonizar ambos sistemas, mucho más próximos, en realidad, de lo que habitualmente se piensa. Tantas veces, lo que cómodamente atribuimos a las "diferencias entre sistemas", no son sino simple manifestación de "desconocimiento de los sistemas". A propósito del tópico de la diferenciación entre ambos sistemas, el jurista alemán Ernst Rabel (1874-1955), romanista antes que comparatista, solía decir que el civil law tenía más de uncommon law que de civil law propiamente; y que el common law se caracterizaba mejor como uncivil law que como Derecho angloamericano. Razón no le faltaba.
