This Master's thesis analyses the legal protection of software in China, in order to answer the questions, why the enforcement of the norms protecting software does not work effectively and why the piracy rate of software is so high in China. Firstly, the protection of intellectual property and software rights, in general and on an international level, are analysed, in order to build an understanding of the subject at hand. Secondly, the legislation protecting intellectual property rights in China is examined. Finally, an economic analysis supports the argumentation. The formal norms of software protection are corresponding to international standards and hardly inhibit the enforcement. The main reason for the ineffective enforcement is the fact that administrative and judicial authorities, which are in charge of enforcing software rights, are often understaffed, have low funding, are dependent on local governments and have little political power. Additionally, the enforcement is inhibited by corruption, local protectionism and lack of judicial personnel educated in the area of intellectual property rights.
