Choosing Models of Society and Social Norms offers an innovative approach to social norms and decision-making that encourages the identification of social norms, along with their causes and consequences. Adolfo Critto points out that social norms condition behavior, but are also conditioned by human decisions. He notes that social norms generally only provide partial and temporary solutions to human needs and problems, so must be critically analyzed in order to understand their relationship to decision making. Critto approaches this relationship through "sacred" (focused on transcendent ends) and "expedient" (focused on efficient means) value orientations, warning that a one-sided focus on either of these orientations leads to inconsistency. He stresses the importance of language, communication, and education, showing how they relate to social norms. Through his analysis, the author provides an understanding of the creation of social norms, what influences them, and the evaluation of those that already exist.

Self-reference, although a topic studied by some philosophers and known to a number of other disciplines, has received comparatively little explicit attention. For the most part the focus of studies of self-reference has been on its logical and linguistic aspects, with perhaps disproportionate emphasis placed on the reflexive paradoxes. The eight-volume Macmillan Encyclopedia of Philosophy, for example, does not contain a single entry in its index under "self-reference", and in connection with "reflexivity" mentions only "relations", "classes", and "sets". Yet, in this volume, the introductory essay identifies some 75 varieties and occurrences of self-reference in a wide range of disciplines, and the bibliography contains more than 1,200 citations to English language works about reflexivity. The contributed papers investigate a number of forms and applications of self-reference, and examine some of the challenges posed by its difficult temperament. The editors hope that readers of this volume will gain a richer sense of the sti11largely unexplored frontiers of reflexivity, and of the indispensability of reflexive concepts and methods to foundational inquiries in philosophy, logic, language, and into the freedom, personality and intelligence of persons.

This book proposes the study of norms as a method of explaining human choice and behaviour by introducing a new scientific perspective. The science of norms may here be broadly understood as a social science which includes elements from both the behavioural and legal sciences. It is given that a science of norms is not normative in the sense of prescribing what is right or wrong in various situations. Compared with legal science, sociology of law has an interest in the operational side of legal rules and regulation. The great civilizations of the world are very different from one another, indeed more strangely different the closer they come in economic, social, and cultural interaction. Yet each claims to be a normative way of being human. At the very minimum human achievement requires competence in the conventions of one's own civilization. To be human is to participate in a conventional culture, and the normatively human conventional cultures are different. Here is the "clash of civilizations": Without commitment to some conventions of civilized humanity, no one can be human; yet the conventions are different, perhaps even opposed. Two problems bring philosophy to the refiner's fire. How can we conceive of human culture across the differences of civilized cultures? This is a problem about the nature of theory itself. It calls for a new theory of theorizing that at once provides synoptic understanding and recognized differences and incommensurabilities. Many postmodern critics have thundered against theories that oppress by the value-laden bias of their own forms, and by the interest guiding their forms. Neville provides a theory of theories that responds to these challenges and addresses the problem of theorizing across different cultures. The other problem is how to exercise practical reason across cultures expressive of different civilizations. How can human beings be responsible in a world where all values seem culture-bound and the obvious solution seems to be moral relativism that trivializes responsibility? Neville presents a theory of practical reason oriented to objective norms determined cross-culturally and based on a Confucian sense of the ritual character of the most important levels of moral life. This book completes Neville's series, Axiology of Thinking, a trilogy of systematically related studies of valuation in four kinds of thinking: imagination, interpretation, theorizing, and the pursuit of responsibility. This book – which is the result of several years of research, discussion, writing and re-writing – consists of three parts and eight chapters. The rst part is given by the two rst chapters introducing the issue of validity and facticity in law. The second part (Chapters 3, 4 and 5) is the core of this study and tries to present a theory based on a speci c view about language and social practice. The third part deal with the issue of value judgments and views about morality and consists of Chapters 6 and 7. Chapter 8 should nally serve as epilogue. In the rst chapter a discussion is started about the relationship between law and power, seen as a presupposition for an assessment of the nature of law. As a matter of fact, as has been remarked, “general theories of law struggle to do justice to the 1 multiple dualities of the law”. Indeed, law has a “dual nature”: it is a fact, but it also a norm, a sort of ideal entity. Law is sanction, but it is also discourse. It is effectivity, or facticity, but it is also a vehicle of principles among which the central one is justice. But this duality is not only a phenomenological, or a matter of justi cation and implementation as two separate moments.
