La Historia Social de las Instituciones Punitivas está necesitada en España de encuentro y debate, de confrontación y colaboración entre investigadores e investigadoras. Social History of Punitive Institutions in Spain needs meetings and discussions, comparison and collaboration between researchers. Only then it will become visible and intelligible as a historiographical trend and, above all, as a theoretical-methodological hope, because in fact, now it is more than conceivable as a historiographical practice. Here in this book are outlined, along with the achievements, the shortcomings and the most pressing challenges. Far from seeking an extemporaneous autonomy, Social History of Punitive Institutions wants to try to find its own feasibility based on intersections and good mixings. Those objectives were considered by the Study Group about History of Prison and Punitive Institutions (Grupo de Estudio sobre la Historia de la Prisión y las Instituciones Punitivas, GEHPIP) –an interuniversity team and with central office at Universidad de Castilla-La Mancha (UCLM)– when organising what it decided to name in an homonymous way 1st International Congress on History of Prison and Punitive Institutions (I Congreso Internacional sobre Historia de la Prisión y las Instituciones Punitivas), held in Ciudad Real (Spain) from 10 to 12 April 2013. This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

This book examines the role that science and culture held as instruments of nationalization policies during the first phase of the Franco regime in Spain. It considers the reciprocal relationship between political legitimacy and developments in science and culture, and explores the ‘nationalization’ efforts in Spain in the 1940s and 1950s, via the complex process of transmitting narratives of national identity, through ideas, representations and homogenizing practices. Taking an interdisciplinary approach, the volume features insights into how scientific and cultural language and symbols were used to formulate national identity, through institutions, resource distribution and specific national policies. Split into five parts, the collection considers policies in the Francoist ‘New State’, the role of women in these debates, and perspectives on the nationalization and internationalization efforts that made use of scientific and cultural spheres. The public authorities have not successfully resolved the management of the traumatic memory of the wars, dictatorships and massacres to which the European project was always intended to be a counterpoint. The conflict of memories and the public discourses about the past are latent on ideological, political and cultural levels. However, if in the past the conflict concerning memories tended to develop inside the borders of countries, it has now leapt into the European arena. This has also led to the confrontation and questioning of the great narratives established in the common memory, especially with countries of the East joining the European Union. Each community, group or nation maintains common memories that do not always fit in or converge with a general overall account. The origins of the UB Solidarity Foundation’s European Observatory on Memories lie in these debates, and through this book — which includes the contributions of specialists in multiple disciplines and the speeches that were given at the first international symposium, “Memory and Power: A Transnational Perspective” — it hopes to present some of the key challenges that this conflict of memories has in store for us in the present and in the future.
