La nostra versione del Nuovo Codice dei contratti pubblici, mette a disposizione del lettore una Parte Prima nella quale trova posto l’intero articolato del Nuovo Codice, con i necessari rimandi al Dlgs 50/2016 al D.lgs 163/2006. Infatti, sia per i bandi pubblicati fino al 30 giugno 2023 sia a causa della disciplina transitoria, ancora per un po’ continuerà a trovare applicazione il vecchio codice. Inoltre, un’intera sezione è dedicata alle norme semplificatorie e derogatorie introdotte dal legislatore a partire dal 2019 ad oggi (DL 32/2019, DL 76/2020, DL 77/2021 e DL 13/2023) e che costituiscono il corpus normativo degli affidamenti finanziati dal PNRR e PNC. Nella Parte Terza trovano posto, invece, una serie di norme, per così dire, trasversali agli appalti come la legge sul Procedimento L. 241/1990, il DPR 445/2000 e un’ampia selezione di articoli del Codice dell’Amministrazione Digitale. Nella Parte Quarta si è deciso di trattare il tema della qualificazione delle stazioni appaltanti. Un’ampia selezione degli articoli del codice Civile è stata inserita nella Parte Quinta che riporta le norme riguardanti la capacita giuridica sia delle persone fisiche sia delle persone giuridiche, oltre ai necessari riferimenti normativi in tema di contratti in generale, e società. Non poteva mancare una Parte dedicata alla delicata fase dei controlli e per tale ragione è stata effettuata una selezione di articoli del Codice Penale, del Codice civile, del Codice delle norme antimafia e altre che attengono alle fattispecie che hanno per effetto l’espulsione automatica e non dalla gara. L’ultima Parte, l’ottava, è stata dedicata al Processo Amministrativo di cui al D.lgs 104/2010. Caratteristica peculiare del Nuovo Codice della Key è l’essere, in linea con il Manuale Operativo sugli appalti, un testo dal taglio pratico, in quanto ogni parte si apre con una guida descrittiva che accompagna il lettore in una consultazione consapevole del complesso articolato normativo.
