Pour cette raison, le praticien se doit de bien connaître, en la matière, le cadre juridique et déontologique. Refuser de soigner un patient n'est pas forcément condamnable et peut se faire dans le respect des règles légales. Pour autant, les cas licites de refus de soins sont spécifiquement déterminés et les possibilités du chirurgien-dentiste restent limitées, comme il est détaillé dans la première partie de la thèse. La seconde partie traite du refus de soins opposé par le patient, et de l'attitude que doit adopter le praticien qui y fait face. Il apparaît en effet que le refus de soins par le malade se rattache à un principe fondamental du droit médical. La liberté du malade d'opposer une fin de non-recevoir aux propositions de soins du chirurgien-dentiste se rattache au principe d'intangibilité et d'inviolabilité du corps humain. Cette liberté ne doit toutefois pas empêcher le chirurgien-dentiste d'insister sur la nécessité des soins qu'il se propose de prodiguer. La troisième partie présente l'étude de plusieurs cas, permettant de mieux appréhender en pratique l'application des principes énoncés dans les deux premières parties.
