A recent presidential proposal even encourages states to use unemployment benefits to provide paid time off for new parents. Such initiatives were made in response to trends that showed the number of working mothers rising sharply in the past two decades. By protecting the right of new mothers to return to their previous jobs, maternity-leave statutes seek to help women benefit more from on-the-job training and to reduce the wage gap between mothers and women who have never had children. If maternity-leave initiatives are to fulfill their promise, it is important to understand the extent to which new mothers returned to their old jobs before the passage of such legislation. Jacob Alex Klerman and Arleen Leibowitz use data from the National Longitudinal Survey of Youth (NLSY) and the Current Population Survey (CPS) to analyze job continuity among new mothers prior to the federal Family and Medical Leave Act of 1993 (FMLA). They find that most women working full-time before pregnancy returned to work for the same employer after giving birth. They argue it is unlikely that maternity-leave legislation will have a major effect on job continuity for working mothers, since the attractiveness of a given job may change after a woman gives birth (e.g., such women may want jobs with flexible hours or on-site day care). Such legislation, however, may have other effects on women's lifetime labor market choices.

Using data from the National Longitudinal Survey of Youth, we correlate work status after childbirth with work status before pregnancy to estimate the prevalence, before the legislation, of returns to the preleave employer. Among women working full?time before the pregnancy, return to the prepregnancy employer was quite common. Sixty percent of women who worked full?time before the birth of a child continued to work for the same employer after the child was born. Furthermore, the labor market behavior of most of the remaining 40016 suggests that maternity?leave legislation is unlikely to have a major effect on job continuity. Compared with all demographically similar women, however new mothers have an excess probability of leaving their jobs.

Using data from the National Longitudinal Survey-Youth (NLS-Y), this paper correlates work status after childbirth with work status before pregnancy. Almost all women (nearly 90 percent) who work full-time both before and after childbirth continue to work at the same employer. Thus maternity leave legislation is unlikely to have a major effect on employment continuity. However, compared to all demographically similar women, new mothers do have an excess probability of leaving their jobs. Finally, most maternity leave legislation limits its protections to full-time workers with sufficient job tenure at sufficiently large firms. Using the NLS-Y, the paper estimates that the federal Family Leave Act covers only about a third of all working new mothers. The restriction to full-time workers is relatively unimportant because few part-time workers would satisfy the tenure and firm-size requirements.

CPS data for 1979 to 1988 are used to examine the determinants of employment, actual work, and maternity leave for women in the year following childbirth. Women with better market skills (higher expected wages, older, more education) are more likely than other new mothers to have a job and to work. Among employed women, paid leave is also positively related to market skills. Work responds to childbirth more than employment does, with the greatest differences in the first three months following childbirth. Therefore, most women working when their child was one year old had returned to work within three months of childbirth.

In July 2005, Switzerland introduced the first federal paid maternity leave mandate, offering 14 weeks of leave with 80% of pre-birth earnings. We study the mandate's impact on women's employment and earnings around the birth of their first child, as well as on their subsequent fertility by exploiting unique, rich administrative data in a difference-in-differences set-up. Women covered by the mandate worked and earned more during pregnancy, and also had temporarily increased job continuity with their pre-birth employer after birth. Estimated effects on other labor market outcomes are small or absent, and all dissipate by five years after birth. The mandate instead persistently increased subsequent fertility: affected women were three percentage points more likely to have a second child in the next nine years. Women living in regions that had greater early child care availability experienced a larger increase in subsequent fertility following the mandate, suggesting that child care complements paid maternity leave in helping women balance work and family.

Expanding on previous editions, it is based on an extensive set of new legal and statistical indicators, including coverage in law and in practice of paid maternity leave as well as statutory provision of paternity and parental leave and their evolution over the last 20 years. The report also takes account of the recent economic crisis and austerity measures. It shows how well national laws and practice conform to the ILO Maternity Protection Convention, 2000 (No. 183), its accompanying Recommendation (No. 191) and the Workers with Family Responsibilities Convention, 1981 (No. 156), and offers guidance on policy design and implementation. This report shows that a majority of countries have established legislation to protect and support maternity and paternity at work, even if those provisions do not always meet the ILO standards. One of the persistent challenges is the effective implementation of legislation, to ensure that all workers are able to benefit from these essential labour rights.
