By the end of the 1970s, contaminated sites had emerged as one of the most complex and urgent environmental issues affecting industrialized countries. The authors show that small and prosperous Switzerland is no exception to the pervasive problem of sites contamination, the legacy of past practices in waste management having left some 38,000 contaminated sites throughout the country. This book outlines the problem, offering evidence that open and polycentric environmental decision-making that includes civil society actors is valuable. They propose an understanding of environmental management of contaminated sites as a political process in which institutions frame interactions between strategic actors pursuing sometimes conflicting interests. In the opening chapter, the authors describe the influences of politics and the power relationships between actors involved in decision-making in contaminated sites management, which they term a “wicked problem.” Chapter Two offers a theoretical framework for understanding institutions and the environmental management of contaminated sites. The next five chapters present a detailed case study on environmental management and contaminated sites in Switzerland, focused on the Bonfol Chemical Landfill. The study and analysis covers the establishment of the landfill under the first generation of environmental regulations, its closure and early remediation efforts, and the gambling on the remediation objectives, methods and funding in the first decade of the 21st Century. The concluding chapter discusses the question of whether the strength of environmental regulations, and the type of interactions between public, private, and civil society actors can explain the environmental choices in contaminated sites management. Drawing lessons from research, the authors debate the value of institutional flexibility for dealing with environmental issues such as contaminated sites.

Son développement quantitatif et qualitatif, réclamé à cor et à cri par les particuliers et les associations de défense de l’environnement, est désormais imposé par des textes internationaux et communautaires. Sa mise en oeuvre n’est cependant pas sans entraîner certains inconvénients pratiques et sans soulever de délicates questions juridiques. Dans la première partie de l’ouvrage, l’auteur dresse de manière systématique l’état du droit positif wallon de la participation : les décisions et actes administratifs qui y sont soumis, les personnes qui peuvent participer, les procédures qu’elles doivent suivre pour le faire et les effets juridiques de leur intervention. Après avoir évoqué l’obligation de restructurer cette matière, l’auteur fournit, dans la seconde partie de l’ouvrage, les règles sur la base desquelles le droit positif devrait être contrôlé et remanié : Convention d’Aarhus, droit communautaire dérivé, droit institutionnel et des libertés publiques, droit interne. Enfin, en guise de conclusion générale, l’auteur formule, à destination du législateur et des autorités administratives compétentes, une série de propositions concrètes de modifications du droit positif de la participation.

Pour cette raison, les solutions trouvées par le juge aux différents problèmes que pose l’application du régime Natura 2000 dans les différents États membres méritent l’attention et sera enrichissante tant pour le chercheur que pour le praticien. As part of the activities of the Legal Observatory Natura 2000, this book focuses on legal issues arising from the implementation by the national courts – constitutional, administrative and judicial ones – of the provisions relating to Natura 2000, in order to assess the contribution of the judge to the effectiveness of this regime. The enforcement of this legislation, which encompasses a complex body of technical rules, grounded on scientific concepts difficult to interpret for a non-scientist, is not easy to apply by a non-specialized judge. The use of expertise is essential to determine how a particular standard – for example the «significant» character of an impact – has been met or not. For this reason, the solutions found by the judge to the various problems arising from the application of the Natura 2000 provisions in the different Member States deserve attention and will be rewarding for both researchers and practitioners.
