La struttura del d.Lgs. n. 50/2016, il cosiddetto Codice appalti, è sempre più complessa: le varie modifiche e integrazioni, intervenute dalla sua entrata in vigore ad oggi, l’assenza di un regolamento attuativo sostituito da numerosissimi provvedimenti non aventi sempre forza di legge e in ultimo il d.L. 16 luglio 2020, n. 76 c.d. “decreto legge semplificazioni”, che fra le altre cose prevede un complesso di deroghe limitate nel tempo, hanno creato un insieme normativo vasto e frammentato. Nella realizzazione di un’opera o di un lavoro pubblico, tutto ciò rende difficile tradurre in pratica le vigenti disposizioni, in quanto quasi sempre da queste non si hanno risposte immediate a problemi che richiedono risoluzioni rapide e certe. Al fine di cercare di superare quanto detto e di realizzare un’agile guida tecnico-amministrativa alla fase di esecuzione di un’opera pubblica, questo lavoro è stato concepito in due forme: un testo cartaceo e uno digitale; nel primo, per ogni argomento, è esposta una sintesi della disciplina, mentre nel secondo collegamenti ipertestuali consentono di consultare atti di varia natura onde avere così un quadro più esaustivo e di approfondire l’argomento in molti suoi aspetti. Con la modulistica e gli esempi riportati a fine paragrafo si ha la traduzione pratica di quanto dettato dalle vigenti disposizioni.

Neoliberalism has been studied as a political ideology, an historical moment, an economic programme, an institutional model, and a totalising political project. Yet the role of law in the neoliberal story has been relatively neglected, and the idea of neoliberalism as a juridical project has yet to be considered. That is: neoliberal law and its interrelations with neoliberal politics and economics has remained almost entirely neglected as a subject of research and debate. This book provides a systematic attempt to develop a holistic and coherent understanding of the relationship between law and neoliberalism. It does not, however, examine law and neoliberalism as fixed entities or as philosophical categories. And neither is its objective to uncover or devise a ‘law of neoliberalism’. Instead, it uses empirical evidence to explore and theorise the relationship between law and neoliberalism as dynamic and complex social phenomena. Developing a nuanced concept of ‘neoliberal legality’, neoliberalism, it is argued here, is as much a juridical project as a political and economic one.
