Esta síntesis de política pública expone la problemática asociada con el papel que tienen los distintos órdenes del Estado en términos de la adscripción de responsabilidades respecto al diseño, la implementación y el seguimiento de las políticas públicas ambientales en cada país. En América Latina y el Caribe, la definición de estos roles es confusa debido a debilidades en las capacidades institucionales, estructuras legales intricadas, falta de coordinación entre los distintos niveles de gobierno y entre las autoridades de distintas regiones o Estados federados, dificultades en la definición sobre las formas de tratamiento de la política ambiental y la incongruencia entre los distintos intereses políticos y los objetivos ambientales. Las enseñanzas del Federalismo Ambiental podrían contribuir a dar respuesta a estas inquietudes y ayudar a resolver de manera efectiva las distintas externalidades ambientales negativas en la región. En este contexto, se observa un riesgo en procesos de descentralización administrativa y fiscal que conduzcan a una carrera hacia el fondo (“race to the bottom”) en el establecimiento de estándares ambientales.
