La incapacidad temporal por contingencias comunes es una situación en la que un trabajador, debido a un accidente o enfermedad no laboral, no se encuentra capacitado para llevar a cabo su trabajo y recibe asistencia sanitaria por parte del Sistema Público de Salud. Se exigen tres requisitos para ser beneficiario del subsidio de incapacidad temporal, estar afiliado y en alta o en situación asimilada al alta en la fecha del hecho causante, mientras estén imposibilitados para trabajar y reciban asistencia sanitaria de la Seguridad Social; padecer la situación determinante de la incapacidad; y cumplir el periodo de cotización, en caso de enfermedad común, los 180 días dentro de los 5 años inmediatamente anteriores a la fecha de la baja por esta causa, si bien en caso de accidente no laboral no se exigirá tal carencia. La prestación consiste en un subsidio cuya cuantía dependerá de la base reguladora y de los porcentajes aplicables a la misma. En los tres primeros días, el trabajador no percibe ni prestación económica ni salario, desde el día 4o al 15o estando de baja, ambos incluidos, la prestación es a cargo de la empresa y a partir del 16o día es a cargo del INSS o de la Mutua Colaboradora.
