"Off the Straight Path"
Author: Elyse Semerdjian
Publisher: Syracuse University Press
ISBN: 9780815631736
Category : Social Science
Languages : en
Pages : 292
Book Description
The legal treatment of sexual behavior is a subject that receives little scholarly attention in the field of Middle East women’s studies. Important questions about the relationship between sexuality and the law and about the societies enforcing that relationship are rarely addressed in the current literature. Elyse Semerdjian’s “Off the Straight Path” takes a bold step toward filling that gap by offering a fascinating look at the historical progression of the treatment of illicit sex under Islamic law. Semerdjian provides a comprehensive review of the concept of zina, i.e., sexual indiscretion, by exploring the diverse interpretation of zina crime as presented in a variety of sources from the Qur’an and hadith to legal literature. She then delves into the history of legal responses to zina within the specific community of Aleppo, Syria. Drawing on a wealth of shari‘a court records, Semerdjian provides a realistic view of Syrian society during the Ottoman period. With vivid detail, she describes specific women’s lives and experiences as their cases are presented before the court. Semerdjian argues that the actual treatment of zina crimes in the courts differs substantially from sentences prescribed by codified Islamic jurisprudence. In contrast to the violent corporal punishments dictated in the Islamic legal code, the courts often punished crimes of sexual indiscretion with nonviolent sentences, such as removal from the community. Employing exceptional insight, “Off the Straight Path” presents a powerful challenge to the traditional view of Islamic law, enabling a richer understanding of Islamic society.

Governing Property, Making the Modern State
Author: Martha Mundy
Publisher: Bloomsbury Publishing
ISBN: 0857713027
Category : Social Science
Languages : en
Pages : 321
Book Description
Was 'modernity' in the Middle East merely imported piecemeal from the West? Did Ottoman society really consist of islands of sophistication in a sea of tribal conservatism, as has so often been claimed? In this groundbreaking new book, Martha Mundy and Richard Saumarez Smith draw on over a decade of primary source research to argue that, contrary to such stereotypes, a distinctively Ottoman process of modernisation was achieved by the end of the nineteenth century with great social consequences for all who lived through it. Modernisation touched women as intimately as men: the authors' careful work explores the impact of Ottoman legal reforms, such as granting women equal rights to land. Mundy and Saumarez Smith have painstakingly recreated a picture of such processes through both new archival material and the testimony of surviving witnesses to the period. This book will not only affect the way we look at Ottoman society, it will change our understanding of the relationship between East, West and modernity.

Book Description
The Jurist Ebu's-su`ud (c1490-1574) occupies a key position in the history of Islamic Law. He was a scholar who, for forty years, occupied successfully the senior judicial positions in the Ottoman Empire. Confronting the problem of reconciling classical Islamic jurisprudence with the day-to-day legal needs of an empire, he earned an enduring reputation as the jurist who harmonised the Holy Law of Islam with secular practice. The book examines the substance of this reputation by showing, through Ebu's-su`ud's writings, how he adapted classical Islamic legal doctrine to contemporary needs.

Beyond the Exotic
Author: Amira El-Azhary Sonbol
Publisher: Syracuse University Press
ISBN: 0815655436
Category : Social Science
Languages : en
Pages : 561
Book Description
Most research has accepted stereotypical images of Muslim women, treating their outward manifestations, such as veiling, as passive and oppressive. Muslim women have been depicted as different, and by exoticizing (orientalizing) them—or Islamic society in general—"they" have been dealt with outside of general women’s history and regarded as having little to contribute to the writing of world history or to the life of their sisters worldwide. By approaching widely used sources with different questions and methodologies, and by using new or little-used material (with much primary research), this book redresses these deficiencies. Scholars revisit and reevaluate scripture and scriptural interpretation; church records involving non-Muslim women of the Arab world; archival court records dating from the present back to the Ottoman period; and the oral and material culture and its written record, including oral history, textbooks, sufi practices, and the politics of dress. By deconstructing the past, these scholars offer fresh perspectives on women’s roles and aspirations in Middle East societies.
