Il reste indeniable que sur la scene internationale, il y a des cas ou les individus se sentent leses dans leurs droits par les autorites d'un pays sur le territoire duquel ils resident ou sejournent. Se trouvant dans cette situation, les personnes privees sont, en effet, incapables juridiquement d'obtenir directement reparation dans l'ordre international car elles n'en sont pas les sujets de cette systeme. Neanmoins, l'individu peut faire appel a son Etat d'origine en vue de defendre ses droits en prenant fait et cause en sa faveur au moyen de la protection diplomatique. Par le biais de l'endossement, l'Etat fait sien le dommage subi par la victime et ce mecanisme de protection diplomatique tend donc a reparer l'absence de personnalite juridique de l'individu en droit international. Ce faisant, l'Etat n'agit pas au nom du particulier lese mais exerce un droit qui lui appartient en propre, d'ou le caractere discretionnaire de la protection diplomatique qui fait de la protection diplomatique un droit exclusif de l'Etat. Il ressort de nos analyses que le caractere discretionnaire de la protection diplomatique est bel et bien source d'une certaine insecurite pour l'individu en ce sens qu'elle reste une possibilite aleatoire ne donnant aucune assurance a l'individu. L'individu reste donc ainsi tributaire de la discretionnarite du droit etatique d'agir, ce qui le desarmerait en cas de l'inaction de son Etat National de tout moyen de droit pour faire entendre sa cause sur la scene internationale.
