Excerpt from The Contract of Sale in the Civil Law: With References to the Laws of England, Scotland and France His Honour Judge Chalmers, that there is hardly a judg ment of importance on the law of Sale in which reference is not made to it.' At the same time, for the convenience of those who from choice or necessity may desire to study the original, I have printed at the end of the book the two Titles in the Digest (xviii. I and xix. I) which bear most directly on the subject, and which are usually prescribed, in connection with it, in examinations, and I have prepared a kind of Index which shows the references in the body of the work to most of the other Titles in the Corpus Iuris which relate to this contract. N o attempt has been made to trace the historical evolution of the law of Sale. What was its actual origin, as a con sensual contract, in the Roman system is a question of very great interest, which has been investigated by some of the most learned and penetrating of the historical jurists on the Continent, and which has engaged others, both there and in England, in speculations which have hitherto led to no very satisfactory results. Until some sure ground has been reached it would be foolish to discuss such a matter in a book which it is intended and hoped will be of real use to lawyers in this country, and accordingly I have in the main contented myself with setting forth the principles of the contract, as they are to be found in the Code, Digest and Institutes, although I have not refrained from historical disquisition where the actual origin of a rule is known beyond all question.
