We have your letter of May 29, concerning opinion no. 73-286, of August 22, 1973, and enclosing a letter from Mr. O'Keefe. He argues, as anticipated in the 1973 opinion, that K.S.A. 1972 Supp. 22-3609 provides an independent and, as it were, self- contained, statement of the right to appeal and the manner of doing so, and makes no reference to any requirement of a cost deposit.

You advise that pursuant to K.S.A. 59-215, the probate judge of Crawford County receives an annual salary of $8,757. In addition, he receives the amount of $2,500 under K.S.A. 59-211c. ... A five percent increase was granted by the 1973 Legislature in the compensation fixed by K.S.A. 29-215. However, no comparable increase was provided for the compensation allowed by K.S.A. 59-211c. You indicate that the filing fee has been established on the basis of the combined annual compensation allowed by K.S.A. 59-211c and -215, with the resulting 'problem ... that it appears the $2,500.00 provided for in 59-211c is being treated as salary for establishing filing fees but is not salary for establishing salary increase.'
