"Executive Order 12866 ... provides guidance to agencies for submitting proposed regulations to the Office of Management and Budget (OMB) for pre-approval. The amendment (Executive Order 13422) expands this process by requiring agencies to submit proposed significant guidance documents for pre-approval. The Order also requires for the first time that agencies identify in writing the specific market failure or problem that warrants the proposed regulation or guidance; that a Presi- dential appointee in each agency be designated as regulatory policy officer and that officer must approve each regulatory undertaking by the agency"--Page 3.
