The authors question the purpose of science without freedom, and subsequently the purpose of political communities without free science. Although the book uses European case studies to answer these questions, it undoubtedly has global relevance: what would be left of the present notion of the ‘global world’ were we to conceive of its character without modern science? Higher education institutions need to be imbued with democratic culture and that, in turn, helps to promote democratic values in the wider society. None of these issues are simple and the lines between legitimacy and illegitimacy are sometimes hard to discern, as is illustrated by perspectives from Europe, North America, Asia, Australia and the Mediterranean region.

Is academic freedom threatened? The book examines current challenges to academic freedom in Europe, focusing mainly on Italy and Germany. The cases discussed demonstrate that research and teaching are under pressure in European democracies: in Hungary and Poland due to political constraints, in other countries due to societal expectations. The Future of Higher Education – Bologna Process Researchers Conference (FOHE-BPRC) has already established itself as a landmark in the European higher education environment. The two previous editions (17-19 October 2011, 24-26 November 2014), with approximately 200 European and international participants each, covering more than 50 countries each, were organized prior to the Ministerial Conferences, thus encouraging a consistent dialogue between researchers and policy makers. The main conclusions of the FOHE Conferences were presented at the EHEA Ministerial Conferences (2012 and 2015), in order to make the voice of researchers better heard by European policy and decision makers. This article focuses on the EU's role in setting the framework for higher education in Europe. The topic has special relevance, as major changes have been made in the sector in certain member states, like Hungary and Poland, and some of these changes are connected with the rule-of-law backsliding in these countries. The paper argues that the European Union should develop a list of fundamental rights that it wants to enforce in higher education among the member states and that this procedure has already started in certain instances. On the other hand, as the EU has linked higher education to single-market regulations, it cannot proceed concerning the issues that do not have a connection with the market. This inactivity could create ambivalence in judging the same or similar questions and has the potential to create discriminative situations. The article claims that, unlike common presumptions, the EU could find itself competent to act if it would interpret rights in higher education from a fundamental rights perspective instead of solely protecting market rationality.
