Alors que la mythologie du viol construit ce crime comme un événement extraordinairecausé par un inconnu déviant, cette thèse propose une conceptualisation du « violordinaire » à partir de trois critères : la relation de proximité entre la victime etl'auteur, la situation de quotidienneté et l'intimité entre les deux individus. Le conceptde viol ordinaire, loin de banaliser les violences de genre, permet de dévoiler lesmécanismes hétéronormés à l'oeuvre dans la (re)production des violences sexuelles,dans le sillage des théorisation féministes américaines du « date rape » des années1980. À partir des savoirs expérientiels de cinq femmes recueillis lors d'entretienssemi-directifs, ce travail de recherche analyse les injustices épistémiques que cesvictimes subissent lorsqu'elles cherchent à qualifier, témoigner et dénoncer leur viol(injustices herméneutiques, testimoniales, agentielles, silenciation, etc.).L'épistémologie féministe du positionnement a permis de se décentrer dessignifications pénales de ce qui rend justice et des comportements déterminés par lafigure de la « victime idéale ». En effet les attentes de justice épistémique identifiéesne correspondent pas aux logiques et finalités pénales, qu'il s'agisse, pour lesvictimes, de nommer l'événement à l'aune du continuum de la violence sexuelle, defaire le récit du viol et de ses conséquences sans que leur crédibilité ne soit évaluée,d'être reconnue en tant que victime sans devoir performer des normes stéréotypéesou de confronter l'homme qui a commis le viol pour obtenir des réponses à leursquestions. Cette thèse montre que le paradigme de la justice réparatrice est à mêmede répondre à ces attentes normatives par les espaces de dialogue et d'écouteinconditionnelle qu'il propose. À partir d'un travail de terrain réalisé au Québec au seind'un réseau de justice réparatrice extra-judiciaire, cette recherche démontre que lamédiation relationnelle observée permet aux victimes de se réapproprier leuragentivité épistémique, radicalement niée pendant le viol.

This original new work is the fascinating result of sociologist and documentary filmmaker Agnès De Féo’s ten-year exploration of the phenomenon of niqab wearing. It is at once a groundbreaking study and a series of compelling first-person accounts from French and Francophone women who wear or have worn the niqab in France’s Salafi communities. With the backdrop of the French government’s 2010 ban on full facial veiling in public spaces, which itself has shaped the phenomenon, De Féo draws on her subjects’ own words to show their agency, working against the clichés that often underlie public views of the niqab—that it is purely the result of masculine pressure, for example, or extreme religiosity or nationalism, or the submissive desire to disappear. Instead, she shows, the niqab is multivalent: women wear it for reasons that range from religious piety to the desire to rebel against mainstream society, family, or the rule of law. The reasons are complex, overdetermined, contradictory, or even inconsistent, but they are the women’s own. Despite being worn only by a small minority of Muslim women, the Islamic garment has nonetheless been a major source of intense political, religious, and cultural debate in France. Searching to understand, rather than speculate, De Féo chose to approach the people who wear the niqab, and to make them, rather the veil itself, the subject of her research. In this book, which closely examines the techniques used by the polemists of the Dreyfus Affair, much is learned not only about the Mair itself, but also about the polemic of the age in which it was situated, and the interaction between writers and their public. The discourse within which people's thoughts were imprisoned is seen not merely to have reflected events, but to have created them, in an increasingly vicious circle whereby the language of popular abuse, incorporated into the written polemic of the Press, produced simple but distorted ideas which in turn were fed back into the people. The age's complete lack of concern for the libel laws led to particularly vivid examples of the art. We are shown how authors' shifts in vocabulary, and in stylistic techniques, unconsciously signal to us fundamental changes in their aims; and how, in the give-and-take of battle, words and concepts subtly changed their meaning, with certain abstract notions such as Truth and Justice becoming completely devalued.
