The law serves a function that is not often taken seriously enough by ethicists, namely practicability. A consequence of practicability is that law requires elaborated and explicit methodologies that determine how to do things with norms. This consequence forms the core idea behind this book, which employs methods from legal theory to inform and examine debates on methodology in applied ethics, particularly bioethics. It is argued that almost all legal methods have counterparts in applied ethics, which indicates that much can be gained from comparative study of the two. The author first outlines methods as used in legal theory, focusing on deductive reasoning with statutes as well as analogical reasoning with precedent cases. He then examines three representative kinds of contemporary ethical theories, Beauchamp and Childress’s principlism, Jonsen and Toulmin’s casuistry, and two versions of consequentialism—Singer’s preference utilitarianism and Hooker’s rule-consequentialism—with regards to their methods. These examinations lead to the Morisprudence Model for methods in applied ethics.

Over the past two decades, applied ethics has turned increasingly toward theories that explore ethical questions faced by a variety of professions and away from classic moral concerns. Abraham Edel, Elizabeth Flower, and Finbarr O'Connor utilize examples of professional, public policy, and personal decision making to illustrate the strengths and limitations of the application of ethics in a rapidly changing world. They first discuss the emergence of applied ethics and how it functions within a philosophical tradition. They are not concerned, however, with solving the problems they expose, but with employing them as a means to critique applied ethics. Using human rights and health and welfare issues, the authors examine the subsequent ethical stumbling blocks that surround the "moral order" of these social concerns. Through a historical discussion of the abundant ethical theories posited since the Enlightenment, they suggest ways to decide which can serve as intellectual tools for applied ethics and consider how knowledge and experience enter into any moral decision. Turning to the factors pertinent in the analysis and solution of moral problems, they dissect the underlying influences on the practice of ethics, the way in which a moral problem is diagnosed and its relevant contexts established, the ensuing conflicts between the concerns of the individual and of society, and the degree of inventiveness in issues of morality. Most philosophers and political scientists readily admit that Thomas Hobbes is a significant figure in the history of political thought. His theory was, arguably, one of the first to provide a justification for political legitimacy from the perspective of each individual subject. Many excellent books and articles have examined the justification and structure of Hobbes’ commonwealth, ethical system, and interpretation of Christianity. What is troubling is that the Hobbesian project has been largely missing in the applied ethics and public policy literature. We often find applications of Kantian deontology, Bentham’s or Mill’s utilitarianism, Rawls’s contractualism, the ethics of care, and various iterations of virtue ethics. Hobbesian accounts are routinely ignored and often derided. This is unfortunate because Hobbes’s project offers a unique perspective. To ignore it, when such a perspective would be fruitful to apply to another set of theoretical questions, is a problem in need of a remedy. This volume seeks to eliminate (or, at the very least, partially fill) this gap in the literature. Not only will this volume appeal to those that are generally familiar with Hobbesian scholarship, it will also appeal to a variety of readers that are largely unfamiliar with Hobbes.
