"The European Union is on the threshold of an important institutional transformation, as thirteen states are applying for membership: ten of them, Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia and Slovenia, will become a member by May 1st, 2004; two countries, Bulgaria and Romania, will follow some time later and Turkey is also given the perspective of accession in a later stage. Fears are often expressed as to the social impact the adhesion of these states may have upon both the European Union's social security policy and the social security systems of these states. We give a presentation of the social security systems of the applicant states in the same format as the one we used for our earlier descriptions of the national social security systems of the present fifteen member states (Nr. 1 of this Social Europe Series). This publication gives the reader an introduction into the social security systems of the thirteen applicant states. It offers the social security expert with some comparative experience the opportunity to position his/her knowledge of (aspects of) foreign social security systems within the broad national context of these systems; for others, this introduction will simplify first ventures into the field of comparative social security law. The publication also facilitates the broad comparison of the national systems, by describing them according to a uniform structure. For each country, the following aspects are examined: the concept and sources of social security law; the administrative organisation; the personal scope of application; the social risks and benefits (subdivided into old age, survivorship, incapacity for work, unemployment, health care and care, family and need); the way in which social security is financed and the judicial protection. By giving a systematised and short overview of all systems in the European Union, the book finally meets a need of many in and outside Europe."--cover.

The social security of the European Union (EU) has become of vital significance for persons living or working in a EU Member State. The creation of the European Economic Area and near accession of the candidate Members (East European countries) has further increased the relevance of this law. This book describes EU social security law, beginning with the rules relevant to migrant workers. Coverage includes Regulations 1408/71 and 574/72 and the case law of the Court of Justice of the EC. The book analyses the contributions of these judgments to the developments of coordination law and to the realisation of the objective of free movement of workers. In this respect the relation of the Regulation and the EC Treaty, which is shown in for instance the Kohll and Decker judgments, is analysed. Special attention is paid to the Proposal for Simplification and Modernisation of Regulation 1408/71. A second main part of EU social security law is the law on equal treatment of men and women. The Court of Justice issued several main decisions, of which the Barber judgment is a wellknown example. Free movement of persons would not be possible without the guarantee that citizens do not lose their social security rights when moving to another Member State, be it for reasons linked to work or for other reasons. In order to safeguard the social security rights of persons moving within the EU/EFTA, common rules are established at EU level. The outcome of the EU rules on social security coordination is a high-quality level of coordination techniques based on some key principles: a) the prohibition of discrimination, reinforced by the equal treatment of cross-border facts and events (i.e. principle of assimilation); b) the aggregation of insurance periods; c) the exportability of benefits; and d) the determination of a single applicable legislation. The Coordination Regulations only 'coordinate' the various social security systems. Consequently, Member States are still free to decide what benefits to grant, to whom, under what circumstances and for how long. Moreover, coordination can be applied only in respect of legislation concerning social benefits which are within the material scope of the Coordination Regulations. It covers the following branches of social security: sickness benefits, maternity and equivalent paternity benefits, invalidity benefits, old-age benefits, survivors' benefits, benefits in respect of accidents at work and occupational diseases, death grants, unemployment benefits, pre-retirement benefits, and family benefits. The Coordination Regulations also apply to special non-contributory cash benefits but not to social and medical assistance and certain benefits which are a compensation for damages. Article 91 of the Implementing Regulation requires the competent authorities to compile statistics on the application of the Coordination Regulations and to forward them to the Administrative Commission for the Coordination of Social Security Systems. Such data are of great importance, as they illustrate the impact of the Coordination Regulations, both in terms of persons involved and related public spending. This statistical report provides an overview and evaluation of the current data collection and reporting on the EU coordination of social security systems. It draws conclusions and identifies trends by area of social security. The separate thematic reports could be consulted for a more detailed analysis and reporting of the data.

This edited volume aims to reveal the Janus-faced character of federalism in the European Union. Federalism appears in two main forms in the EU. On the one hand, numerous formerly unitary Member States have embarked on a path towards a (quasi-)federal governance structure. On the other hand, the EU itself is sometimes qualified as a federal system. Significantly, the concept of federalism has a very different, even opposite, connotation in both contexts. When associated with Member State reform, federalism is regarded as a technique for accommodating autonomy claims of sub-state nations. By contrast, when federalism is used as a label for the EU itself, it is conceived as a far-reaching way of integrating the nations of Europe. This dual appearance of federalism in the EU context is central to the structure of the book. The first collection of essays addresses the question whether the EU may be described as a federal system, and whether it can learn from existing federations. This work examines the system of co-ordination of national social security laws in the European Union from a gender perspective. The central question that it raises concerns the level of social security protection enjoyed by women moving throughout the Union in cases of work interruption or marriage dissolution. Women's social security protection has traditionally been based on two criteria, namely economic activity and family/marriage. Work interruptions, in particular for child-rearing, challenge the invocation of economic activity as an effective basis for social security rights. Changing social and family conditions, including the emergence of atypical relationships and increasing divorce rates, challenge the criterion of family/marriage. Efforts have been made within the framework of the national systems of the Member States to address these challenges, often unsuccessfully. So, how successful has the European system of co-ordination, the aim of which is to provide a sufficient level of protection to migrant workers and their families, been in addressing these challenges? The book contains comprehensive discussion of the phenomenon and legal institution of social security, as well as a thorough analysis of the current state of European Community law concerning co-ordination, with a particular focus on gender. It identifies several problematic areas where solutions must be worked out and action taken. The book fills a gap in the legal literature on the social security field and will appeal to those with an interest in social security, including academics, policy-makers and practitioners.
