In The Serbian Project and Its Adversaries James Gow provides the first military-political analysis of the Yugoslav conflicts, arguing that Slobodan Milosevic and his Serbian allies used ethnic cleansing as a method of creating and consolidating borders. Although he considers the approaches taken by Belgrade's adversaries, Gow argues that Serbia's deliberate strategy of ethnic cleansing was at the heart of the war and that it was in essence criminal; in other words, it was a strategy of war crimes. Based on interviews, examination of research undertaken by the Office of the Prosecutor at the International Criminal Tribunal for the former Yugoslavia, and other Yugoslav materials, The Serbian Project and Its Adversaries establishes the legitimacy of the Tribunal's jurisdiction. Gow distinguishes between acts of war, war crimes, and crimes against humanity and suggests that a strategic understanding of the war may mitigate some of the charges being made against Serbian military and political leaders.

This book offers a comprehensive analysis of the trial of former Serbian leader Slobodan Milošević at the International Criminal Tribunal for the former Yugoslavia (ICTY). With the premature death of Milošević in March 2006 his trial was left unfinished. Although the traditional objectives of criminal law, such as retribution, justice for victims, and deterrence, were not achieved, the Milošević trial archive is a significant historical resource for researchers from various fields. This book explores the role of actors in determining transitional justice in peacebuilding contexts. In recent decades, transitional justice mechanisms and processes have been introduced to a variety of settings, becoming widely regarded as essential elements in the ‘peacebuilding toolbox’. While it has increasingly been suggested that transitional justice is imposed by neo-imperial actors with little regard for the needs and cultures of local populations, evidence suggests that dismissing these policies as neo-imperial or neo-liberal impositions would result in grossly overlooking their dynamics, which involve a whole range of relevant actors operating at multiple levels. This book interrogates this theme through empirical analysis of three sites of peacebuilding that have seen extensive international involvement: Kosovo, East Timor and Afghanistan. It proposes a novel framework for analysing and approaching transitional justice in peacebuilding that disaggregates three broad sets of actors operating at different levels in relevant processes: external actors (international and regional levels), transitional justice promoters (local, national, international and transnational levels), and transitional regimes (national and local levels). The book argues that transitional justice in peacebuilding must be conceived of as actor-contingent and malleable due to the significance of agency and (inter)actions of key categories of actors throughout peacebuilding transition. Bosnia Remade is an authoritative account of ethnic cleansing and its partial undoing from the onset of the 1990s Bosnian wars up through the present. Gerard Toal and Carl Dahlman combine a bird's-eye view of the entire war from onset to aftermath with a micro-level account of three towns that underwent ethnic cleansing and--later--the return of refugees. There have been two major attempts to remake the ethnic geography of Bosnia since 1991. In the first instance, ascendant ethno-nationalist forces tried to eradicate the mixed ethnic geographies of Bosnia's towns, villages and communities. These forces devastated tens of thousands of homes and lives, but they failed to destroy Bosnia-Herzegovina as a polity. In the second attempt, which followed the war, the international community, in league with Bosnian officials, endeavored to reverse the demographic and other consequences of this ethnic cleansing. While progress has been uneven, this latter effort has transformed the ethnic demography of Bosnia and moved the nation beyond its recent segregationist past. By showing how ethnic cleansing was challenged, Bosnia Remade offers more than just a comprehensive narrative of Europe's worst political crisis of the past two decades.
