This edited volume examines the link between constitutional asymmetry and multinationalism in multi-tiered systems through a comprehensive and rigorous comparative analysis, covering countries in Europe, Africa and Asia. Constitutional asymmetry means that the component units of a federation do not have equal relationships with each other and with the federal authority. Federalism is an increasingly common approach to improving governance and resolving ethnic conflict in Asia. However, Asian federalism faces three thorny problems. First, the ethnic federalism paradigm dominates political and intellectual life, rendering political compromise difficult and creating an obstacle to establishing or improving federalism in Asia. Second, religious fundamentalism and secular refusal to accommodate religious demands pose an existential threat to federal politics. Federalism is a very familiar form of government. It characterises the first modern constitution-that of the United States-and has been deployed by constitution-makers to manage large and internally diverse polities at various key stages in the history of the modern state. Despite its pervasiveness in practice, this book argues that federalism has been strangely neglected by constitutional theory. It has tended either to be subsumed within one default account of modern constitutionalism, or it has been treated as an exotic outlier - a sui generis model of the state, rather than a form of constitutional ordering for the state. This neglect is both unsatisfactory in conceptual terms and problematic for constitutional practitioners, obscuring as it does the core meaning, purpose and applicability of federalism as a specific model of constitutionalism with which to organise territorially pluralised and demotically complex states. In fact, the federal contract represents a highly distinctive order of rule which in turn requires a particular, 'territorialised' approach to many of the fundamental concepts with which constitutionalists and political actors operate: constituent power, the nature of sovereignty, subjecthood and citizenship, the relationship between institutions and constitutional authority, patterns of constitutional change and, ultimately, the legitimacy link between constitutionalism and democracy. In rethinking the idea and practice of federalism, this book adopts a root and branch recalibration of the federal contract. It does so by analysing federalism through the conceptual categories that characterise the nature of modern constitutionalism: foundations, authority, subjecthood, purpose, design and dynamics. This approach seeks to explain and in so doing revitalise federalism as a discrete, capacious and adaptable concept of rule that can be deployed imaginatively to facilitate the deep territorial variety that characterises so many states in the 21st century.

This volume examines and analyses electoral politics in Sri Lanka through the theoretical framework of manipulation. The following questions guided the study: how do political actors manipulate elections, and what are the salient features of electoral politics in Sri Lanka? Primary and secondary data formed the basis of the analysis, examining eight presidential elections. The research findings indicated that Sri Lankan governments, political parties and political leaders have taken advantage of six types of electoral manipulation, including constitutional tinkering, field fixing, time fixing, vote suppression, process manipulation and resource manipulation. Through a close examination of eight presidential elections, research carried out for the volume found that elections are often associated with violence; presidential elections are mainly a majoritarian affair in which minority communities play only a marginal role; there is a significant gender imbalance, as women’s participation in the electoral process is very limited; despite the presence of a large number of candidates contesting the election, it always remains a two-way race; and amid extensive manipulation and other problems, voter participation tends to be high. This volume will be a valuable resource for students, academics and researchers who focus on democracy, good governance, electoral studies and South Asian politics and history, and will enhance the conceptual foundation of democracy advocates and activists.
