Excerpt from Responsibility in Mental Disease Were the observer, whether casual or skilled, to reside for some length of time in an asylum, and thus to make himself practically acquainted with the ways, thoughts, and feelings of its inmates, he would certam discover how great a mistake it is to suppose, as is often done, that they are always so alienated from themselves and from their kind as not to be influenced by the same motives as sane persons in what they do or forbear to do. When an insane person is on his trial for some criminal offence, it is commonly taken for granted by the lawyers that if an ordinary motive for the act, such as anger, revenge, jealousy, or any other passion, can be dis covered, there is no ground to allege insanity, or, at any rate, no ground to allege exemption from re sponsibility by reason of insanity. Excerpt from The Criminal Insane in the United States and in Foreign Countries The softened modern sentiment toward the insane exposes society to a new danger. It is that criminals may take advantage of the plea of insanity to secure acquittal or commitment to a hospital instead of to a prison. The necessity, therefore, of protecting the prisoner on one hand and of protecting society on the other has introduced marked changes in modern law and methods of practice in the courts of civi lized countries. We are obliged to ask to-day whether the prisoner was sane when the act with which he is charged was committed. At least we are obliged to meet this question whenever it is raised. He may have been sane when the act was committed and be insane at the time of his trial, or he may have been insane when the act was committed though sane at the time of trial, or he may become insane after he is convicted and sentenced and while serving his term in prison. The irresponsibility of the prisoner thus creates a new responsibility for society. It is the responsibility, first, of determining whether an accused person is or was mentally diseased, and then of deciding what form of treatment the person shall receive. It may be acquittal if his recovery and harmlessness are beyond doubt, or it may be committal to a hospital or to a Special asylum for the criminal insane. Excerpt from The Responsibility or Guiteau It is not always easy, sometimes it is impossible, to say whether a crime is an insane act or not. Two young women, for instance, killed their babies under circumstances that might suggest either irresponsibility or great hardness of nature and cruelty. In both there was about the same amount of external evidence of insanity, in neither case very clear. The one was happily married, and, so far as could be known, had no possible sane motive for killing her child. When left alone with it for a little while she kindled a fire in the kitchen stove and heated to boiling some water, into which she threw her infant. Upon the return of her servant she was found sitting by the shapeless mass smiling, but refused to say why the deed had been done. In the insane asylum, to which she was sent, there was, for some months, no indication of insanity beyond the facts that she never spoke, and that she had an expression of quiet satisfaction on her face unnatural, under the circumstances, to a sane person. Her physical health was good, and the ordinary relations of the asy lum life were properly attended to. She was orderly and quiet, and understood, as well as performed, what was required of her. Several months later, she said that she had killed her child because her husband had bestowed improper attentions upon her maid, -a pure delusion, which, even if it had foundation, would not have justified the act in law. Excerpt from Provision for Insane Criminals Public sentiment is, however, an unsafe guide in this mat ter. It follows a pendulum course itself and is swayed, now this way, now that, as the gravity of the fundamental interests of society, or the secret springs of sympathy and sentiment may direct. We have had in early times the punishment of numerous innocent insane persons; in later times a revulsion of feeling in favor of insanity as an excuse of crime; then a reaction against the improper use of this plea; and with each ebb and flow of popular feeling, guilty men have escaped and innocent men have suffered. I wish here at the outset to disclaim all sympathy with the excessive and injurious benevolence which sees in all crimes, only the misfortunes and not the fault of their perpetrators, and inveighs against the present defects of society as the res ponsible agency. It may well be that the fatal snare of evil inheritance and environment makes criminals in many instances what they are, and that with the external conditions reversed, the relative position of the criminal and the executioner of the law would also be reversed; but the vicious and de structive influences which would annihilate all order and all progress, can only be met by stern repression and control. It is true that society has a duty toward the criminal beyond simply immuring him where he can do no harm; but swift and certain punishment is also an essential part of' that duty, and the direction in which progress is to be made is (let) in the more careful adjustment of the penalty to the measure of responsibility; (2d) in the judicious introduction of agencies within the prison which will carefully foster whatever there may be left of right-mindedness in the individual criminal.
