The book charts the principal course of civil rights against the dramatic backdrop of two world wars, the Great Depression, the affluent society of the postwar world, the cultural and social agitation of the 1960s, and the emergence of the new conservatism of the 1970s and 1980s. A right to equality and non-discrimination is widely seen as fundamental in democratic legal systems. But failure to identify the human interest that equality aims to uphold reinforces the argument of those who attack it as morally empty or unsubstantiated and weakens its status as a fundamental human right. This book argues that an understanding of the human interest which equality aims to uphold is feasible within the jurisprudence of the European Court of Human Rights (ECtHR) and the European Court of Justice (ECJ). In comparing the evolution of the prohibition of discrimination in the case-law of both Courts, Charilaos Nikolaidis demonstrates that conceptual convergence within the European Convention on Human Rights (ECHR) and the EU on the issue of equality is not as far as it might appear initially. With the passage of the Voting Rights Act in 1965, the right of minorities to register and vote was largely secured. It was soon discovered, however, that minority voting did not guarantee the election of minorities or minority-preferred candidates. Indeed, efforts by states and localities in the second half of the 1960s were aimed at denying any substantial minority representation to go along with the ability to cast ballots. Eventually congressional amendments to the Act along with the Supreme Court opinion in Thornburg v. Gingles (1986) have led to efforts to eliminate electoral laws that have the effect of diluting the minority vote, whether or not they were enacted with discriminatory intent. Controversy still surrounds the matter of minority representation, however, because of the ambiguity of certain aspects of the law and because of problems in applying it to the largely single-member district context of the 1990s. This book is the most up-to-date treatment of voting rights law and the numerous controversies surrounding minority representation. The authors have extensive, firsthand experience in both the legal battles and the scholarly examination of these issues. Based on this wealth of experience, they describe the development of the law after 1965, discuss in detail the prevailing Supreme Court interpretation of the Voting Rights Act, and examine discrepancies in federal court interpretations of subsequent actions. They also introduce the reader to technical procedures for establishing standards of representation and measuring discrimination. The New Deal placed security at the center of American political and economic life by establishing an explicit partnership between the state, economy, and citizens. In America, unlike anywhere else in the world, most people depend overwhelmingly on private health insurance and employee benefits. The astounding rise of this phenomenon from before World War II, however, has been largely overlooked. In this powerful history of the American reliance on employment-based benefits, Jennifer Klein examines the interwoven politics of social provision and labor relations from the 1910s to the 1960s. Through a narrative that connects the commercial life insurance industry, the politics of Social Security, organized labor's quest for economic security, and the evolution of modern health insurance, she shows how the firm-centered welfare system emerged. Moreover, the imperatives of industrial relations, Klein argues, shaped public and private social security. Looking closely at unions and communities, Klein uncovers the wide range of alternative, community-based health plans that had begun to germinate in the 1930s and 1940s but that eventually succumbed to commercial health insurance and pensions. She also illuminates the contests to define "security"--job security, health security, and old age security--following World War II. For All These Rights traces the fate of the New Deal emphasis on social entitlement as the private sector competed with and emulated Roosevelt's Social Security program.
