Following independence, the Nehruvian approach to socialism in India rested on three pillars: secularism and democracy in the political domain, state intervention in the economy, and diplomatic non-alignment mitigated by pro-Soviet leanings after the 1960s. This book illuminates the experiences of a set of students and faculty who are members of the Dalit caste – commonly known as the ‘untouchables’ – and are relatively ‘successful’ in that they attend or are academics at a prestigious university. The book provides a background to the study, exploring the role of caste and its enduring influence on social relations in all aspects of life. The book also contains a critical account of the current experiences of Dalit students and faculty in one elite university setting – the University of Shah Jahan (pseudonym). Drawing on a set of in-depth semi-structured interviews, the empirical study that is at the centre of this book explores the perceptions of staff and students in relation to the Quota policy and their experiences of living, working and studying in this elite setting. The data chapters are organised in such a way as to first explore the faculty views. The experiences of students are then examined with a focus on the way in which their caste is still an everyday part of how they are sometimes ‘othered’. Should quotas in education and employment be treated as matters of policy and not of right? Is the individual or groups of the community the fundamental bearer of rights and capacities? Can past disparities be adequately redressed? The author begins to address these issues with a sociological critique of the equality provisions in the Constitution of India. He argues that the problem is not simply of the contradiction between the principle of equality and the practice of inequality, but also of the tensions between divergent concepts of equality. He focuses on the problem of balancing the principle of equal opportunities with the principle of redress, citing disparities between groups that were such a striking feature of traditional India. The author argues that if caste quotas are treated as matters of right and extended indefinitely, there will be irreparable damage to institutions such as universities, hospitals and banks that are governed by principles that are radically different from those governing the relations between castes.

This book examines the controversial 103rd Constitutional Amendment to the Indian Constitution that introduced an income and asset ownership-based new constitutional standard for determining backwardness marking a significant shift in the government’s social and public policy. It also analyses state level policies towards backwardness recognition of upper-caste dominant groups through case studies of Maharashtra, Haryana, and Gujarat. It provides an analytical and descriptive account of the proliferation of reservation policy in India and critiques these interventions to assess their implication on constitutional jurisprudence. Further, it assesses the theoretical and empirical challenges such developments pose to the principle of substantive equality and scope of affirmative action policies in Indian constitutional law and general discrimination law theory.
